To deviate from the minimum lot size or width requirements in the large <br />lot district. <br /> <br />Given that there are several economic and infrastructure issues associated with <br />the proposed changes as approved for rural Large Lot district. The applicant cited <br />some personal reasons for this particular request. Provisions of Section 106-191 <br />provide the flexibility/ relief for these development challenges. The <br />parameters for the requested special exception may meet the provisions <br />established by Section 106-191 of the Code of Ordinances. <br /> <br />After review of Section 106-191 b (4), this Special Exception would not be <br />contrary to the public's interest and will not adversely affect the value or use <br />of adjacent properties. A subdivision of this nature would not resemble a <br />conventional subdivision plat due to the fact that it forms only two lots, one <br />additional residence, and stays within the spirit of the Large Lot District. <br /> <br />The application merits review by the Board based upon the parameters set by <br />the Ordinance. The Board may consider: <br /> <br />~ Approving Special Exception and allowing the subdivision of <br />property as follows: a) lot with existing house to be 0.5 acre with <br />140' width, and b) lot for future home to be 1.35 acres with only 48' <br />width. <br />~ Denying Special Exception and allow the provision of Section 106- <br />416(a)(b) to remain in place. <br /> <br />As per Section 106-196 of the Code of Ordinances of the City of La Porte: <br />Any person or persons, jointly or severally, aggrieved by any decision of the <br />Board of Adjustment, or any taxpayer, or any officer, department, board or <br />bureau of the city may present to a court of record a petition for a writ of <br />certiorari, as provided by V T CA., Local Government Code Section <br />211.011, duly verified, settingforth that such decision is illegal, in whole or <br />in part, specifYing the grounds of the illegality. Such petition shall be <br />presented to the court within ten days after the filing of the decision in the <br />office of the Board of Aqjustment. <br />
