Zoning Board of Adjustment <br />Minutes of March 22, 2012 <br />Members Present: Rod Rothermel, Charles Schoppe, Chester Pool, T.J. Walker, and Sherman <br />Moore (Alt. No. 2). <br />Members Absent: George Maltsberger, Lawrence McNeal (Alt. No 1), <br />City Staff Present: Masood Malik, City Planner; Clark Askins, Assistant City Attorney; and Shannon <br />Green, Planning Assistant. <br />1. Call to Order. <br />Vice Chairman Rod Rothermel called the meeting to order at 6:00p.m. <br />2. Consider approval of the February 23, 2012, meeting minutes. <br />Motion by Charles Schoppe to approve the Minutes of February 23, 2012, Second by Sherman <br />Moore. Motion carried. <br />Ayes: Rod Rothermel, Charles Schoppe, Chester Pool, T.J. Walker, and Sherman Moore <br />(Alt. No. 2). <br />Nays: None <br />Abstain: None <br />3. Consider Special Exception Request #12-94000001 for the property located at 106 North <br />Forrest Avenue, further described as Lot 17, Block 10, Sylvan Beach First Subdivision, <br />Vol.3, Page 72, Harris County Map Records, Johnson Hunter Survey, Abstract No. 35, La <br />Porte, Harris County, Texas. The applicant seeks to construct a covered walkway in the <br />front setback area. This exception is being sought under the terms of Section 106-191 (b) <br />(2)(a) of the City's Code of Ordinances. <br />A. STAFF PRESENTATION <br />Masood Malik, City Planner, presented staffs report. Mr. Malik informed the Board the applicant is <br />requesting to construct a covered walkway in the front setback area. This exception is being <br />sought under the terms of Section 106-191 (b) (2) (a) of the City's Code of Ordinances. <br />Twelve public hearing notices were mailed to property owners within 200' of the subject property. <br />The City received one response in favor. <br />B. PROPONENTS <br />Applicant, James Prestigamo spoke in favor of the Special Exception. <br />C. OPPONENTS <br />There were none. <br />D. PROPONENTS REBUTTAL <br />There were none. <br />Motion by Charles Schoppe to approve Special Exception Request #12-94000001, for the <br />property located at 106 North Forrest Avenue. Second by Chester Pool. Motion carried. <br />Ayes: Rod Rothermel, Charles Schoppe, Chester Pool, T.J. Walker, and Sherman <br />Moore (Alt. No. 2). <br />Nays: <br />Abstain: <br />4. Consider Appeal of Enforcement Officer's Decision #12-96000001 for the property located <br />at 500 West Main Street, further described as Lots 21-23, Block 56, Town of La Porte, <br />Johnson Hunter Survey, Abstract No. 36, La Porte, Harris County, Texas. The applicant <br />appeals for a denied permit for Obsolescence of Structure, the repair costs of which exceed <br />
