No. 343 <br />A BILL TO BE ENTITLED <br />AN ACT relating to the conformity of local law with state law. <br />BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: <br />SECTION 1.Chapter 1, Local Government Code, is amended by <br />adding Section 1.006 to read as follows: <br />Sec.1.006. CONFORMITY WITH STATE LAW. (a) Where the <br />state has passed a general statute or rule regulating a subject, a <br />local government shall restrict its jurisdiction and the passage of <br />its ordinances, rules, and regulations to and in conformity with <br />the state statute or rule on the same subject, unless the local <br />government is otherwise expressly authorized by statute. <br />(b) Unless expressly authorized by state statute, a local <br />government shall not implement an ordinance, rule, or regulation <br />that conflicts with or is more stringent than a state statute or <br />rule regardless of when the state statute or rule takes effect. <br />SECTION 2. This Act takes effect immediately if it receives <br />a vote of two-thirds of all the members elected to each house, as <br />provided by Section 39, Article III, Texas Constitution. If this <br />Act does not receive the vote necessary for immediate effect, this <br />Act takes effect September 1, 2015. <br /> <br />
