Bayway <br />th <br />owns the lot between 309 N. 4 Street and the parking lot for Jennie Riley Center. The lot is an <br />irregular size and does not currently meet the minimum lot size for single family home <br />construction. <br />Bayway would like to purchase 12’ of land from the City to meet the minimum standard of 60’ <br />lot. The requested 12’ strip of property is currently vacant property, as the parking lot does not <br />extend to the southern property line. As no additional expansion is contemplated for the parking <br />lot, the City does not have any objection to this proposed property acquisition. <br />An appraisal was conducted and the purchase price for the 1,500 square feet is $2,625. <br />Section 272.001(b)(1) of the Local Government Code provides an exemption to the auction <br />requirement for sale of property owned by the City. This property meets the definition of “narrow <br />strips of land, or land that because of its shape, lack of access to public roads, or small area cannot be <br />used independently under its current zoning or under applicable subdivision or other development <br />control ordinances.” <br />Staff recommends the sale of the 12’ strip of land to Bayway Homes to facilitate the construction of a <br />single family home. <br />Action Required by Council: <br />Consider approval or other action to sell a 12’ strip of land to Bayway Homes to facilitate the <br />construction of a single family home. <br />Approved for City Council Agenda <br />___________________________________ _______________________ <br />Corby D.
