REQUEST FOR CITY COUNCIL AGENDA ITEM <br />Appropriation <br />Agenda Date Requested:January 11, 2021 <br />Requested By:Ian Clowes, City Planner Source of Funds:N/A <br />Department:Planning & Development <br />Account Number:N/A <br />Amount Budgeted:N/A <br />ReportResolutionOrdinance <br />Amount Requested:N/A <br />Exhibits: Ordinance2021-3812, Deed, Area Map, <br />Budgeted Item:YesNo <br />Appraisal Summary <br />SUMMARY& RECOMMENDATION <br />The City of La Porte Planning & Development Department received an application from <br />Justin Bennett, on behalf of WEJCO Properties, LPto vacate, abandon and close the <br />sixteen (16) foot alley right-of-wayin Block 375, Town of La Porte, and that portion of the <br />NorthJ Street right-of-way situated between North Broadway and North 1st Street, <br />adjacent to the property legally described as Lots 1-32, Block 375, La Porte Subdivision. <br />The abandonment process requires that all adjacent property owners either participate <br />in the closure or sign away rights to their portion of the proposed closure. Lancaster <br />Interest, LLC, the only other adjacent property owner, decided not to participate in Mr. <br />Bennett <br />sixteen (16) foot alleyright-of-way. <br />The total area of the requested closure is 27,680square feet. The area to be closed and <br />abandoned is already being utilized bythe adjacentdevelopment for storage and parking. <br />The requested closure will allow the right-of-way to legally become part of the overall <br />development. <br />Staff have determined that there are no City or franchised utilities existing within the right- <br />of-way. Comcast, AT&T, and CenterPoint, the three (3) franchise utility companies, have <br />all provided letters of no objection to the proposed right-of-wayclosure. <br />In accordance with Sections 62- <br />an appraisalof the subject right-of-wayto establish fair market value. The appraisal report <br />established a value of $2.50per square foot. The applicant has submitted closing fees in <br /> <br />
