Broadway, LLC to vacate, abandon and close a <br />portion of the North 1st Street right-of-way situated between North J Street and Reserve A, <br />Block 1 of La Porte Landfill and a portion of the North J Street right-of-way situated between <br />North 2nd Street right-of-way and an abandoned section of North J Street right-of-way, adjacent <br />to the property legally described as Lots 1-16 & 28, Block 375, La Porte Subdivision. <br />The abandonment process requires that all adjacent property owners either participate <br />in the closure or sign away rights to their portion of the proposed closure. La Porte Real <br />Property, LLC, the only other adjacent property owner, decided not to participate in Mr. <br />Bennett's request and has authorized conveyance of their portion of the described North <br />1st Street and North J Street rights -of -way. <br />The total area of the requested closure is 50,080 square feet. The area to be closed and <br />abandoned will be incorporated into the existing development to the east and north. <br />Staff have determined that there are no City or franchised utilities existing within the right- <br />of-way. Comcast, AT&T, and CenterPoint, the three (3) franchise utility companies, have <br />all provided letters of no objection to the proposed right-of-way closure. <br />Sections 62-32 of the City's Code of Ordinances requires the city obtain an appraisal of <br />any subject right-of-way proposed for closure. The applicant requested closure of <br />adjacent right-of-way (North J St.) in December of 2020. Staff agreed that the appraisal <br />conducted at that time would be sufficient for the current proposed closure. A copy of the <br />North J St. appraisal summary has been included in the packet.
