PlanningandZoningCommissionRegularMeeting <br />October30,2014 <br />Chapter106ProposedRevisions <br />PlanningandDevelopmentDepartment <br />StaffReport <br />ISSUE <br />Followingthepublichearing,shouldthePlanningandZoningCommissionconsider <br />recommendingapprovaltotheCityCounciltheproposedmodificationstoChapter106 <br />(Zoning)aspresentedintheattachedExhibitA? <br />DISCUSSION <br />ThePlanningandZoningCommissionheldapublichearingonthisitematthe <br />September25,2014meetingandcontinuedthepublichearingtotheOctober30,2014 <br />meetingtoprovideCouncilmemberspresentatthepublichearinganopportunityto <br />furtherdiscussacoupleofissueswiththeSubcommitteepriortotheCommission <br />makingaformalrecommendationtotheCityCouncil.TheSubcommitteeandstaffheld <br />ameetingtodiscussthoseitemsandasaresultarepresentingafewmodificationsfor <br />considerationthatareresponsivetotheCouncilmembersconcern.However,rather <br />thanprintinganewChapter106,staffispresentingthosesectionsinthisreport.Any <br />recommendationfromtheCommissionshouldincorporatethemodificationsas <br />presentedinthisreport,iftheCommissiondesirestoincorporatethem,as <br />th <br />replacementstothosesectionsinthepreviousversionpresentedattheSeptember25 <br />publichearing.Pleasenotethattheredtext,whetherhighlightorstrikethrough, <br />representsthechangefromthepreviousversion.Thoseyellowhighlightedsectionswith <br />blacktextremainthesameasthepreviousversion. <br />Sec. 106-680. Exterior building designs. <br />The material used on the exterior facade of all commercial and industrial buildings within the <br />city's TIRZ No. 1 shall conform to the requirements below and in accordance to the appropriate <br />zoning district, land uses, and visibility of the site. Any new nonresidential development in the <br />city’s TIRZ No. 1 is subject to the applicable provisions in Article IX, Design Guidelines. Where <br />such development is located on a thoroughfare not identified in the requirements of Article IX or <br />on a thoroughfare identified as a Tier 3, then said project shall be subject to the requirements in <br />Tier 2. <br />(a)Minimum exterior wall standard for any building visible from a major thoroughfare or <br />directly abutting residential development shall be 100 percent masonry or glass, e.g. <br />brick, stone brick veneer, tilt wall, decorative or textured concrete block, split face block, <br />stucco, and EIFS (exterior insulation and finish systems). <br />(b)All nonconforming structures must come into compliance with the above standards <br />whenever a permit is desired and under review per sections106-262(Nonconforming <br />structures)and106-268(Nonconforming lots of record)of this article.
