The provisions of this division shall be administered by the <br />Director of Planning and Development or designee. <br />(1) Existing buildings shall also conform to these requirements upon <br />expansion of over one-third of an area of improvement/development. <br />(2) In case of structural damage to the front of the building due to fire, <br />flood or other reasons, and the cost of redevelopment is in excess of 50 <br />percent of the value (replacement cost by the certified appraisal) the structure <br />shall conform to these above requirements. <br />(3) The standards and criteria contained within this section are deemed to <br />be minimum standards and shall apply to buildings constructed after the <br />effective date of this ordinance. Buildings constructed after the effective date of <br />this ordinance shall at all times comply with the provision of this division and <br />the version of the building design guidelines in force at the time of the building <br />permit application. <br />Sec. 106-XXX. Review procedures. <br />(a) The provisions of this section shall be reviewed as part of the requirements of Section <br />106-236 (Certified site plan required). <br />(b) Any waivers to the provisions of this section require approval by the Planning and Zoning <br />Commission. The Planning and Zoning Commission may approve a waiver request subject to the <br />following findings: <br />(1) The project as designed is consistent with the general spirit and intent of the City <br />of La Porte's Comprehensive Plan. <br />(2) The proposed building will result in an attractive contribution to the community. <br />Sec. 106-XXX. Architectural design guidelines. <br />(a) Building Form (Applicable to Tier 1 and 2) <br />(1) All buildings shall be designed and constructed in tripartite architectureso that <br />they have a distinct base, middle and top. <br />Examples of Single Story Tri-Partite <br />(b) Building Articulation (Applicable to Tier 1 and 2) <br />(1) Primary facades clearly visible from a public street or along an active storefront <br />shall meet the following minimum standards for articulation: <br />Horizontal Articulation. <br />a. No building wall shall extend for a distance <br />equal to 3 times the wall’s height without having an off set equal to 25% of the <br />wall’s height, and that new plane shall extend for a distance equal to at least 25% <br />of the maximum length of the first plane. <br />Vertical Articulation. <br />b.
