PlanningandZoningCommission <br />MinutesofSeptember25,2014 <br />Page2of10 <br />a.StaffPresentation <br />CityPlannerEricEnseypresentedthestaffreport.CSTBrands,Inc.,onbehalfofPort <br />CrossingLandLP,hasrequestedapprovalofaSpecialConditionalUsePermit(SCUP)to <br />allowconstructionofaconveniencestoreandgasstationona3.45acretractofland <br />locatedatthe <br />southwestcornerofSH146andWhartonWeems. <br />Notificationofthepublichearingwasmailedtoallpropertyowners(6)within200feetof <br />thesubjectsite.NoresponsestothenotificationwerereceivedbytheCity;however,theLa <br />PorteIndependentSchoolDistrictsubmittedResolutionNo.201422,ͻƭƷƩƚƓŭƌǤ <br />ƚƦƦƚƭźƓŭͼ <br />therequestedSCUP. <br />StaffhasreviewedtheğƦƦƌźĭğƓƷƭrequestandproposedthefollowingconditionsbeplaced <br />ontheSCUP,ifrecommendedforapprovalbytheCommission: <br />1.Asitedevelopmentplanshallbesubmittedinaccordancewithapplicablerequirements <br />oftheCityofLatƚƩƷĻƭDevelopmentOrdinance. <br />2.TheplanshallcomplywithallotherprovisionsofChapter106,ͻƚƓźƓŭͼofthe/źƷǤƭ <br />CodeofOrdinancesandallotherdepartmentreviewsandapplicablelawsand <br />ordinancesoftheCityofLaPorteandtheStateofTexas. <br />3.Allnecessarydocumentationforbuildingpermitreviewmustbesubmittedin <br />conjunctionwiththeĭźƷǤƭbuildingpermitapplicationprocess. <br />4.ExistinglandscapingandmonumentsignageattheintersectionofWhartonWeemsand <br />SH146plantedasaͻŭğƷĻǞğǤͼtothePortCrossingBusinessParkshallbemaintained <br />andincorporatedintothelandscapeplanandirrigationsystemrequiredotherwisefor <br />thedevelopment <br />whichshallalsobemaintainedincompliancewiththe/źƷǤƭCodeof <br />Ordinances. <br />5.Landscaping,includingacombinationoftreesandshrubsshallbeprovidedbetweenthe <br />westedgeofpavementandthewestpropertylineinamannersoastoprovide <br />screeningtotheadjacentproperty.Additionallandscapingshallbeprovidedinthearea <br />betweenthesouthedgeofpavementandthesouthpropertyline.Thislandscapingshall <br />includeamixoftreesandshrubsplantedinamannersoastocreateanamenitytothe <br />site.Atnotimeshallthelandscapeareasouthofthepavementedgeshowinthe <br />proposalbepavedorallowedforvehicleuseorcirculation. <br />6.Atrafficstudyperformedbyalicensedengineershallberequired.Thestudymust <br />ensurethattheproposeddevelopmentwillnotadverselyimpacttheSH146Wharton <br />WeemsintersectionaswellastheSH146frontageroadeastoftheproposedfacility. <br />Anymitigationrequiredbythestudywillbetheresponsibilityoftheapplicant. <br />7.Vehiclesmayparkwithindesignatedparkingspacesonly,exceptwhenfueling.Noover <br />nightparkingofvehiclesispermittedonsite.Theapplicantshallrecordaseparatelegal <br /> <br />
