PlanningandZoningCommissionRegularMeeting <br />July16,2015 <br />LegacyatLaPorteSCUP <br />applicantwillneedtocoordinatewiththeĭźƷǤƭUtilitiesDivisiontocomplywithall <br />minimumrequirementsatthetimeofsiteplansubmittal. <br />Drainage. <br />BecausetheproposeddevelopmentwouldbedrainingintoHarrisCountyfacilities,the <br />applicantwillhavetocomplywithallHarrisCountydrainagerequirements.Basedon <br />theconceptualplansubmittedwiththeproposedSCUP,theapplicantisproposingto <br />provideonsitedetention.ReviewoftheƭźƷĻƭproposeddetentionanddrainagesystem <br />willtakeplaceduringsiteplanreview. <br />Conclusion: <br />Basedontheanalysisabove,stafffindsthatifthePlanningandZoningCommission <br />desirestorecommendapprovaloftheproposedSpecialConditionalUsePermit,thena <br />numberofconditionsshouldbeconsideredintheapproval.Section106217ofthe <br />ZoningOrdinanceoutlinesspecificconditionsforapprovalofSCUPapplications.There <br />arethreedifferentconditionsthatmustbemetinordertoapproveaSCUP.The <br />followingtableidentifieseachofthethreeconditionsandƭƷğŅŅƭfindingoneach: <br />Condition:StaffAnalysis: <br />(1)ThatthespecificusewillbeTheproposedusewillprovideluxurymultifamilyapartmentcomplex <br />compatiblewithandnotinthecity,ofwhichthecitydoesnotcurrentlyhave,therebyfurther <br />injurioustotheuseanddiversifyingthetypesofresidentialproductwithinthecity.Because <br />enjoymentofotherproperty,thepropertyisbeingdevelopedasaluxuryapartmentcomplex,the <br />norsignificantlydiminishorbuildingsandgroundswillbemaintainedatahighlevel.Section106 <br />impairpropertyvalueswithin150ofthecoderequiresminimumbondingandinsurance <br />theimmediatevicinity.requirementsformultifamilydevelopment.Theapplicantwillbe <br />requiredtoprovidethenecessarybondingof$1,000,000asa <br />guaranteeofmaintenance.Additionally,thereareanumberof <br />conditionsrecommendedbystaffaspartoftheproposedSCUPthat <br />areintendedtominimizeanyperceivedorpotentialimpactsofthe <br />proposeddevelopmentonthesurroundingneighborhood. <br />(2)ThattheconditionsplacedonAsaconditionofapprovaloftheproposedSCUP,theapplicantis <br />suchuseasspecifiedineachrequiredtosubmitasitedevelopmentplaninaccordancewiththe <br />districthavebeenmetbytherequirementsoftheĭźƷǤƭDevelopmentOrdinance.Additionally,the <br />applicant.sitedevelopmentplanwillneedtocomplywithallotherprovisionsof <br />theĭźƷǤƭZoningOrdinanceandwillbereviewedduringthesite <br />developmentreview.Inthiscase,staffisrecommendingthatthesite <br />planbeforwardedtothePlanningandZoningCommissionforreview <br />andapproval. <br />(3)ThattheapplicanthasagreedTheapplicantwillneedtoconfirmontherecordatthepublichearing <br />tomeetanyadditionalthattheyareagreeabletotheconditionsimposedontheSCUP.Staff <br />conditionsimposed,basedonhasprovidedalistofconditionsaspartofthisreport.However,the <br />specificsiteconstraints,andCommissionandCityCouncilmayimposeadditionalconditions, <br />necessarytoprotectthepublicshouldtheyapprovetheproposedSCUP. <br />interestandwelfareofthe <br />community. <br />6 <br /> <br />
