BoardofAdjustmentMeeting <br />May26,2016 <br />LemonHouseVariance <br />Criterion:StaffFinding: <br />a.ThatthegrantingofthevariancewillnotbeThegrantingofthevariancesbeingrequested <br />contrarytothepublicinterestwouldallowtheapplicanttheabilitytoreplat <br />Lots19and20andconstructanewhouseonthe <br />northernlot.Becauseofthelocationofthe <br />existingstructuresonthelotsaswellasthe <br />replattingandplacementofthenewlotline,the <br />northernlotcannotcomplywiththeminimum <br />requirementsforlotwidth. <br />b.ThatliteralenforcementofthischapterwillTheselotshavebeenplattedintheircurrentstate <br />resultinunnecessaryhardshipbecauseofsince1911aspartoftheSylvanBeachSubdivision <br />exceptionalnarrowness,shallowness,shape,FinalPlat.Lots19and20wereplattedand <br />topographyorotherextraordinaryorcomplywiththeminimumrequirementsinterms <br />exceptionalphysicalsituationuniquetotheoflotwidthandarea.Howeverbothlotsare <br />specificpieceofpropertyinquestion.plattedtofrontGrove.Theexceptionalhardship <br />"Unnecessaryhardship"shallmeanphysicalthatcouldbearguedisthelocationofthehouse <br />hardshiprelatingtothepropertyitselfasandaccessorybuildingonthesouthernportionof <br />distinguishedfromahardshiprelatingtothelot.Thelocationofthesestructuresdictate <br />convenience,financialconsiderationsortheplacementofthepropertyline,whichdoes <br />caprice,andthehardshipmustnotresultfromnotallowfortheapplicanttocomplywiththe <br />theapplicantorpropertyowner'sownactions.minimumlotsizeandareaforthenorthernlot. <br />Additionally,asitcurrentlyexists,therearetwo <br />primarystructureonthelotsthatbothfront <br />Bayshore.Theproposedvariancewouldallowthe <br />applicanttodemolishoneofthestructures(and <br />itsaccessorybuilding)andconstructanewhouse <br />initsplace. <br />c.Thatbygrantingthevariance,thespiritofthisTheintentofthe/źƷǤƭnonconformingprovisions <br />chapterwillbeobserved.aretobringstructuresintocomplianceovertime, <br />butduetotheconfigurationandlocationof <br />existingbuildingsthisfuturelotwillnotbeableto <br />bereplattedinamannerthatmeetslotwidth <br />requirementsunlessanaccessorybuildingistorn <br />down. <br />AppealProcedure: <br />Sec.106196.Appealsfromtheboardofadjustment. <br /> <br />
