BID VALID 30 DAYS <br />Brooks is not responsible for damage to any underground lines. Brooks reserves the right to accept or reject any order. Any alteration or deviation from above <br />specification involving extra costs will be executed only upon written orders, and will become an extra charge over and above the estimate. It is understood that <br />Brooks has the right to trespass without recourse or repossess all materials not paid for according to the terms of this contract. If the contract is placed with an <br />attorney for suit or collection through probate, bankruptcy, or other local proceedings, customer agrees to pay for all expenses and reasonable attorney fees incurred. <br />Any verbal instructions, agreement, or promises arenot valid unless written as part of this contract. <br />Customer agrees, at his own risk and expense, to designate to Brooks all property boundaries and easements. Customer further agrees to indemnify and hold Brooks, <br />its owners, agents,, employees, heirs and assignees harmless for any damages to any person or property due to encroachment. Brooks does not accept reponsibility for <br />damage or injury to any trees or shrubbery. Brooks is not responsible for stress and shrinkage cracks or cracks due to ground movement or tree roots. Customer <br />agrees to procure and supply, at his own expense, any and all permits required by any political subdivisions for the work specified herein. If the customer does not <br />provide elevations for drainage, Brooks will provide elevations based on existing structures. If elevation does not provide for proper drainage, Brooks will provide <br />elevatinns as hest as no.s.sihle If customer's elevation does not allow for a 2" fall every 10' Brooks cannot he <br />responsible for any water pooling. Brooks is not responsible for acts of vandalism. We propose to furnish materials and labor -complete in accordance with the <br />above specifications. <br />ACCEPTANCE OF PROPOSAL: The above prices, specifications and conditions are satisfactory and are hereby accepted. Brooks is authorized to do the <br />work as specified.
