1.4L IMITATIONS <br />Propertyconditions,aswellaslocal,state,tribal,andfederalregulationscanchangesignificantly <br />overtime.Therefore,therecommendationsandconclusionspresentedasaresultofthis <br />assessmentapplystrictlytotheenvironmentalregulationsandpropertyconditionsexistingat <br />thetimetheassessmentwasperformed.Availableinformationhasbeenanalyzedusingcurrently <br />acceptedassessmenttechniquesanditisbelievedthattheinferencesmadearereasonably <br />representativeoftheproperty.AEImakesnowarranty,expressedorimplied,exceptthatthe <br />serviceshavebeenperformedinaccordancewithgenerallyacceptedenvironmentalproperty <br />assessment practices applicable at the time and location of the assessment. <br />ConsiderationsidentifiedbyASTMasbeyondthescopeofaPhaseIESAthatmayaffectbusiness <br />environmentalriskatagivenpropertyincludethefollowing:ACMs,radon,LBP,leadindrinking <br />water,wetlands,regulatorycompliance,culturalandhistoricalresources,industrialhygiene, <br />healthandsafety,ecologicalresources,endangeredspecies,indoorairquality,mold,andhigh <br />voltagelines.Theseenvironmentalissuesorconditionsmaywarrantassessmentbasedonthe <br />typeofthepropertytransaction;however,theyareconsiderednon-scopeissuesunderASTM <br />Standard Practice E1527-13. <br />Ifrequestedbytheclient,thesenon-scopeissuesarediscussedherein.Otherwise,thepurpose <br />ofthisassessmentissolelytosatisfyoneoftherequirementsforqualificationoftheinnocent <br />landownerdefense,contiguouspropertyownerorbonafideprospectivepurchaserunder <br />CERCLA.ASTMStandardPracticeE1527-13andtheUnitedStatesEPAStandardsandPractices <br />forAllAppropriateInquiries(40CFRPart312)constitutethe"allappropriateinquiryintothe <br />previousownershipandusesofthepropertyconsistentwithgoodcommercialorcustomary <br />practice" as defined in: <br />1.42 U.S.C. ¤ 9601(35)(B), referenced in the ASTM Standard Practice E1527-13. <br />2.Sections101(35)(B)(ii)and(iii)ofCERCLAandreferencedintheEPAStandardsand <br />Practices for All Appropriate Inquiries (40 CFR Part 312). <br />3.42 U.S.C. ¤ 9601(40) and 42 U.S.C. ¤ 9607(q). <br />ThePhaseIESAisnot,andshouldnotbeconstruedas,awarrantyorguaranteeaboutthe <br />presenceorabsenceofenvironmentalcontaminantsthatmayaffecttheproperty.Neitheris <br />theassessmentintendedtoassurecleartitletothepropertyinquestion.Thesolepurpose <br />ofassessmentintopropertytitlerecordsistoascertainahistoricalbasisofpriorlanduse. <br />Allfindings,conclusions,andrecommendationsstatedinthisreportarebaseduponfacts, <br />circumstances,andindustry-acceptedproceduresforsuchservicesastheyexistedatthetime <br />thisreportwasprepared(i.e.,federal,state,andlocallaws,rules,regulations,marketconditions, <br />economicconditions,politicalclimate,andotherapplicablematters).Allfindings,conclusions, <br />andrecommendationsstatedinthisreportarebasedonthedataandinformationprovided,and <br />observations and conditions that existed on the date and time of the property reconnaissance. <br />Responsesreceivedfromlocal,state,orfederalagenciesorothersecondarysourcesof <br />informationaftertheissuanceofthisreportmaychangecertainfacts,findings,conclusions, <br />orcircumstancestothereport.Achangeinanyfact,circumstance,orindustry-accepted <br />procedureuponwhichthisreportwasbasedmayadverselyaffectthefindings,conclusions,and <br />recommendations expressed in this report. <br />Project No. 368495 <br />March 1, 2017 <br />Page10 <br /> <br />
