INTERLOCAL AGREEMENT <br />BETWEEN SAN JACINTO COLLEGE DISTRICT <br />AND CITY OF LA PORTE, TEXAS <br />STATE OF TEXAS § <br /> § <br />COUNTY OF HARRIS § <br />This Agreement is made and entered into this ___ day of ____________, 2013, <br />between SAN JACINTO COLLEGE DISTRICT, a school district formed under the laws of <br />the State of Texas (hereinafter "COLLEGE"), acting by and through its governing body, <br />and the CITY OF LA PORTE, TEXAS, a municipal corporation, (hereinafter "CITY"), <br />acting herein by and through its governing body, both of Harris County, Texas. <br />WHEREAS, this Agreement is made under the authority granted by and pursuant <br />to Chapter 791, Texas Government Code, known as the INTERLOCAL COOPERATION ACT; and <br />WHEREAS, CITY owns a certain Fire Engine which has outlived its useful life <br />but is still of value of use; and <br />WHEREAS, COLLEGE conducts a Program known as the San Jacinto Fire Training <br />Academy, which will utilize the Fire Engine in the training and education of its <br />students; and <br />WHEREAS, CITY and COLLEGE find that transferring the Fire Engine for use in <br />the Program would serve the citizens of La Porte by enhancing the training and <br />education experience of firefighter trainees, benefiting the recruitment pool for <br />the La Porte Fire Department, thereby promoting a public purpose; and <br />WHEREAS, the Parties, in paying for the performance of governmental functions <br />or in performing such governmental function, shall make payments therefore only from <br />revenues legally available to such parties; and <br />WHEREAS, the governmental bodies of each party find that the project or <br />undertaking is necessary for the benefit of the public and that each party has the <br />legal authority to provide such service, and the services are in the common interest <br />of both parties hereto; and that the division of costs and/or responsibilities <br />provided for constitutes adequate consideration to each party, <br />NOW THEREFORE, for and in consideration of the mutual undertaking hereinafter <br />set forth and for adequate consideration given, the parties agree as follows: <br />I. <br />DEFINITIONS <br />The following terms shall have the following meanings when used in this <br />Agreement: <br />4S7HR109XWC0218001998 FERRARA <br />A. "Fire Engine" shall mean that certain motor vehicle, Serial No. , a <br />FIRE PUMPER, MODEL VA40M-2142 <br />originally purchased by the City of La Porte, Texas. A Fire Engine <br />apparatus is a critical learning tool for any State accredited fire academy program where the student learns <br />fire pump theory and operations, fire stream and hose skills, vehicle operation, and other safety training as <br />part of the basic training program. <br />B."Parties" means CITY and COLLEGE. <br /> <br />
