16. Survival of Representations, Warranties and Covenants. <br />The representations, warranties and covenants contained herein are and will be deemed and construed to <br />be continuing representations, warranties and covenants, and will survive the dates of execution of this <br />Settlement Agreement. <br />17. Separate Documents. <br />This Settlement Agreement may be executed in one or more counterparts, each of which shall be <br />deemed an original, but all of which together shall constitute one and the same instrument. <br />18. Applicable Law. <br />For purposes of enforcement or interpretation of the provisions of this Settlement Agreement, the <br />Settling Parties agree that the laws of the State of Texas shall be applicable, except to the extent the Settling <br />Parties agree, or a court determines federal law applies to questions arising under CERCLA. The Settling <br />Parties further agree not to contest personal jurisdiction in any court of law located within Harris County, <br />Texas, with respect to litigation brought for such purposes. <br />19. Entire Agreement. <br />This Settlement Agreement embodies the entire agreement and understanding of the Settling Parties <br />with respect to the subject matter herein, and supersedes any and all prior agreements, arrangements and <br />understandings entered into with respect to the subject matter herein.
