<br />5.Audits & Inspections <br />All records relevant to any matters covered by this Agreement shall be made available to the <br />County, its designees or the Federal government, at any time during normal business hours, as <br />often as the County or other agency deems necessary, to audit, examine, and make excerpts or <br />transcripts of all relevant data. La Porte will respond to the notification of any deficiencies noted <br />in audit reports within thirty (30) days after receipt by the La Porte. Any deficiencies must be <br />fully cleared by La Porte. La Porte agrees to have an annual agency audit conducted in <br />accordance with OMB Super Circular 2 CFR Part 200. <br />6. Failure to Meet Record-Keeping, Reporting, Audit, and/or Inspection Requirements <br />La Porte-keeping, reporting, audits, and/or inspections as <br />required by this Agreement is a breach of this Agreement and funding will be withheld from La <br />Porte until such time as the reports are timely and accurately submitted. The County maintains <br />the right to terminate this Agreement with La Porte for failure to keep records properly, submit <br />reports for three (3) consecutive months, and/or cooperate with audits/inspections. <br />C. Procurement <br /> <br />1. Compliance <br /> <br />La Porte shall comply with the (1) public notice and (2) award of contract to the lowest and most <br />responsible bidder procedures of the Municipal Purchasing Act, TEX. GOVT CODE §252.001 et <br />seq., concerning the purchase of equipment and services and shall maintain an inventory record <br />of all non-expendable personal property, as defined by County policy, that may be procured with <br />funds provided hereunder. La Porte shall procure materials in accordance with the requirements <br />of OMB Super Circular 2 CFR Part 200, Procurement Standards, and shall subsequently <br />follow, Property Standards, covering utilization and disposal of property. <br /> <br />D. Subcontracts <br /> <br />1. Approvals <br />La Porte shall not enter into any subcontracts with any agency or individual in the performance <br />of this Agreement without the written consent of the County prior to the execution of such <br />agreement. <br /> <br />2. Monitoring <br />La Porte shall monitor all subcontracted services on a regular basis to assure contract <br />compliance. Results of monitoring efforts shall be summarized in written reports submitted to the <br />County and supported with documented evidence of follow-up actions taken to correct areas of <br />noncompliance. <br /> <br /> Page 15 of 58 <br /> <br />
