Exhibit C <br /> <br />HARRIS COUNTY COMMUNITY SERVICES DEPARTMENT CONSTRUCTION <br />POLICIES AND GUIDELINES <br />These policies are intended to assist those Contractors/Subcontractors receiving FTA 5307 Grant funds. They will <br /> understanding and compliance with applicable federal and county regulations, <br />policies and processes where the Contractor is responsible for design, bidding and construction contract administration. If <br />clarification is needed, call Gene Simeon, Compliance Manager, at 713-578-2000. <br />1. If federal funds will be used to retain consultants, La Porte must advertise Request for Qualification Statement <br />(RFQ). La Porte <br />330 qualification statements must be submitted for review to Harris County Community Services Department <br />(HCCSD) prior to commissioning the consultants. Upon approval by HCCSD, La Porte may retain consultant(s). <br />2. La Porte shall advertise for bids and award contracts in compliance with the State of Texas bidding procedures <br />and the following subsections of the OMB Super Circular 2 CFR Part 200: <br />Subpart D 200.300-200.309, and Program Management <br />Subpart D 200.317-200.326, "Procurement Standards" <br />Subpart D 200.333-200.337, "Records Retention and Access" <br />3. The preliminary drawings must be within the previously approved project scope. All construction projects must <br />comply with Harris County requirements and the policies and procedures of the Harris County Purchasing Agent, <br />Harris County Auditor, and HCCSD. <br />4. La Porte will incorporate into the construction documents any and all FTA requirements and all construction <br />policies and guidelines contained herein. Final documents must be approved by the County prior to the execution <br />of the contract for construction. <br />5. Prior to award of contract, the County will review the bid documents, the bidder's qualification statements and <br />financial statements to ensure that the contractor has a good contracting record, adequate capitalization, <br />equipment, and personnel to successfully complete the project, meets minority participation goals and that the <br />bidder has not been debarred by FTA from working on federal contracts. <br />6. La Porte, La Porte, and the County shall conduct a pre-bid meeting and a pre-construction <br />conference with the Contractor and Subcontractor(s). <br />7. The County shall furnish La Porte with specific compliance documentation at the pre-construction conference <br />with the Contractor. Without exception, La Porte and the Contractor shall be responsible for ensuring compliance <br />by all Subcontractors working on the project jobsite with employees covered by the Davis-Bacon Act. <br /> <br />8. La Porte shall, at its sole expense, furnish the necessary inspection personnel to assure itself of compliance with <br />the construction contract. La Porte understands and agrees to inspections performed by the County <br />representative. La Porte understands and agrees that shall have full and final authority <br />in all construction disputes. <br />9. La Porte and Contractor shall be responsible for preparing monthly pay requests to be reviewed by La Porte <br />representative prior to submittal for payment.
