an Electrician classification and wage rate on the wage decision, the general contractor <br />cannot request another Electrician classification and wage rate. <br />c. the other wage rates <br />already on the wage decision. For example, the wage rate proposed for a trade classification <br />such as Electrician shall be at least as much as the lowest wage rate for other trade <br />classifications already contained in the wage decision. And, <br />d. The workers that will be employed in the added classification (if it is already known who the <br />rate. <br /> <br />1. County Review. County shall review the request for additional classification and wage rate to <br />determine whether the request meets the DOL rules outlined above and forwards the request to <br />FTA for further review and preliminary approval. If additional information is required, HCCSD <br />shall contact the general contractor for more information. HCCSD shall inform the general <br />contractor in writing in the event that HCCSD <br />above described rules. The written response shall also inform the general contractor of their <br />option to revise and resubmit their request for additional classification and wage rate in order to <br />meet the above described rules. <br /> <br />2. FTA Review. The FTA Labor Relations field staff shall review the request for additional <br />classification and wage rate to determine whether the request meets the DOL rules outlined <br />above. If additional information is required, FTA shall contact the County for more information. <br />If the FTA Labor Relations review finds that the request meets the rules, FTA shall forward to <br />HCCSD their preliminary approval on the request and refer it to DOL for final review and <br />approval. The County shall inform the general Contractor of FTA <br />referral to the DOL. <br />If the FTA Labor Relations review finds that the request for additional classification and wage <br />rate does not meet the above described rules, FTA shall not approve the request. In this case, FTA <br />shall forward to DOL the request with an explanation why FTA believes the request should not be <br />approved. NOTE that the DOL holds the authority on the final decision on the request. The <br />County shall inform the general contractor of FTA <br />3. DOL Review and Decision. The DOL shall respond to FTA in writing about the additional <br />classification request and wage rate request. FTA shall forward to the County the final decision <br />from DOL on the request, while the County <br />decision to be implemented at the job site. <br /> <br />shall include <br />information about the classification and wage rate that shall be used by the contractor at the job <br />site. Upon receipt from FTA response and instructions, the County shall <br />any instructions about the classification and <br />wage rate to be used at the job site. <br />Additional classification criteria and procedures are discussed in more detail in DOL Regulations 29 <br />CFR §5.5. <br />l. Site of Work-Bacon wage rates apply. Usually, this means <br />where the construction called for in the contract will remain when work on it has been completed. <br /> Page 30 of 58 <br /> <br />
