assisted construction contracts in accordance with procedures authorized in Executive Order 11246 of <br />September 24, 1965, and such other sanctions may be imposed and remedies invoked as provided in <br />Executive Order 11246 of September 24, 1965, or by the rule, regulation, or order of the Secretary of Labor, <br />or as otherwise provided by law. <br />8. The Contractor will include the portion of the sentence immediately preceding paragraph (1) and the <br />provisions of paragraphs (1) through (8) in every subcontract or purchase order unless exempted by rules, <br />regulations, or orders of the Secretary of Labor issued pursuant to Section 204 of Executive Order 11246 of <br />September 24, 1965, so that such provisions will be binding upon each subcontractor or vendor. The <br />Contractor will take such action with respect to any subcontract or purchase order as the administering <br />agency may direct as a means of enforcing such provisions, including sanctions for noncompliance. <br />Provided, however, that in the event a Contractor becomes involved in, or is threatened with litigation with a <br />subcontractor or vendor as a result of such direction by the administering agency the contractor may request <br />the United States to enter into such litigation to protect the interests of the United States. <br /> <br />DISADVANTAGED BUSINESS ENTERPRISE (DBE) <br />Goal <br />This contract is subject to the requirements of Title 49, Code of Federal Regulations, Part 26, Participation by <br />Disadvantaged Business Enterprises in Department of Transportation Financial Assistance Programs. The <br />goal for DBE participation is 4%. A separate contract goal of 4% DBE Participation has been established <br />for this contract. <br />Bidders are required to document sufficient DBE participation to meet these goals or, alternatively, document <br />adequate good faith efforts to do so, as provided for in 49 CFR 26.53. Award of this contract is conditioned on <br />submission of the following concurrent with and accompanying sealed bid: <br />1. The names and addresses of DBE firms that will participate in this contract; <br />2. A description of the work each DBE will perform; <br />3. The dollar amount of the participation of each DBE firm participating; <br />4. Written documentation of the bo use a DBE subcontractor whose participation it <br />submits to meet the contract goal; <br />5. Written confirmation from the DBE that it is participating in the contract as provided in the prime <br /> <br />6. If the contract goal is not met, evidence of good faith efforts to do so. <br />Bidders must present the information required above as a matter of responsiveness (see 49 CFR 26.53(3)). <br />Nondiscrimination <br />The Contractor or subcontractor shall not discriminate on the basis of race, color, national origin, or sex in the <br />performance of this contract. The Contractor shall carry out applicable requirements of 49 CFR Part 26 in the <br />award and administration of DOT assisted contracts. Failure by the contractor to carry out these requirements <br />is a material breach of this contract, which may result in the termination of this contract or such other remedy <br />as Harris County deems appropriate, which may include, but is not limited to: <br /> Page 50 of 58 <br /> <br />
