Contractor invoice Harris County CSD for amounts pertaining to subcontractors terminated or substituted <br />without prior approval. <br />ADA ACCESS <br />The Contractor agrees to comply with all applicable requirements of the Americans with Disabilities Act of <br />1990 (ADA), as amended, 42 USC § 12101 et seq.; section 504 of the Rehabilitation Act of 1973, as amended, <br />29 USC § 794; 49 USC § 5301(d); and any implementing requirements FTA may issue. These regulations <br />provide that no handicapped individual, solely by reason of his or her handicap, be excluded from participation <br />in, be denied the benefits of, or be subjected to discrimination under any program or activity included in or <br />resulting from this Agreement. <br />In accordance with Section 102 of the Americans with Disabilities Act, as amended, 42 U.S.C. § 12112 and <br />section 504 of the Rehabilitation Act of 1973, as amended, 29 U.S.C. § 794, the Contractor agrees that it will <br />49 CFR Part 38, pertaining to facilities and equipment to be used in public transportation. In addition, the <br />Contractor agrees to comply with the requirements of 49 U.S.C. § 5301 (d) which expresses the Federal policy <br />that the elderly and persons with disabilities have the same right as other persons to use mass transportation <br />services and facilities, and that special efforts shall be made in planning and designing those services and <br />facilities to implement transportation accessibility rights for elderly persons and persons with disabilities. <br />Contractor also agrees to comply with any implementing requirements FTA may issue. <br />Contractor understands that it is required to include the above clauses in all subcontracts. Failure by the <br />Contractor to carry out these requirements is a material breach of this Agreement, which may result in the <br />termination of this Agreement or such other remedy as the County deems appropriate. <br /> <br /> <br />ACKNOWLEDGEMENT <br />BY SIGNING BELOW, I declare LA PORTE, has duly authorized me to acknowledge and bind its compliance <br />with the required contract clauses above in this section.
