PUBLICATION, PASSAGE AND EFFECTIVE DATE. This Franchise, having been <br />published in the official newspaper of the City of La Porte, Texas once each week for four consecutive weeks <br />after its final passage, shall take effect sixty days after final passage ("Effective Date"). The Company shall pay <br />the cost of those publications. <br />Section 22 COMPLIANCE WITH TEXAS OPEN MEETINGS LAW. The City Council officially <br />finds, determines, recites, and declares that a sufficient written notice of the date, hour, place, and subject of this <br />meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time <br />required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government <br />Code; and that this meeting has been open to the public as required by law at all times during which this ordinance <br />and the subject matter thereof has been discussed, considered, and formally acted upon. The City Council further <br />ratifies, approves, and confirms such written notice and the contents and posting thereof. <br />Section 23. REPEAL. All ordinances or parts of ordinances in conflict herewith are hereby repealed to <br />the extent of the conflict only. <br />Section 24. COMPLIANCE WITH CHARTER AND ORDINANCES. This Franchise, the rights <br />granted hereby and the operations and activities performed by Company pursuant hereto shall be subject to <br />applicable provisions of the Charter of the City of La Porte, Texas. Except to the extent otherwise expressly <br />provided herein, the Franchise and rights granted hereby and the operations and activities performed by Company <br />pursuant hereto, shall be subject to all valid ordinances and regulations of the City insofar as such ordinances and <br />regulations (a) do not shorten the term hereof or terminate, abrogate, or materially and adversely affect the <br />Franchise and right granted to Company hereby, (b) do not conflict with or are not inconsistent with the terms <br />and provisions contained in this ordinance, (c) do not modify, preempt, or cause Company to violate the terms of <br />a tariff approved by the Railroad Commission of Texas, Railroad Commission Rules, or the Gas Utility <br />Regulatory Act, or (d) do not unreasonably regulate the Company's operations and activities in the City Right of <br />Way. <br />
