PlanningandZoningCommissionRegularMeeting <br />September25,2014 <br />Chapter106ProposedRevisions <br />Permits(ArticleII,Division4): <br />7.Section106150,whichaddressesbondingformultifamilydevelopment,wasadopted <br />bytheCityCouncilbutnevercodified.Thissectionhasbeenincluded.The <br />Subcommitteeisalsorecommendingacoupleadditionalmodificationstothissection, <br />whichareinredfont. <br />Firstofall,therehasbeenarequestbymultifamilydeveloperstoallowforotherforms <br />ofassurancesratherthanbondsorirrevocablelettersofcredit.Languagehasbeen <br />addedallowingforconsiderationofotherassurancesifapprovedbythePlanningand <br />ZoningCommission.Thisproposedmodificationhasbeenmadetosubsection(a). <br />Additionallysubsection(b)wasmodifiedtoclarifythestandardsforwhichthis <br />assurancecouldbepulled,includingmaintainingͻƷŷĻhealth,safetyandwelfareofthe <br />tenantsandtheintegrityofthesurroundingƓĻźŭŷĬƚƩŷƚƚķ͵ͼ <br />NonconformingLotsofRecord(Section106268): <br />8.Section106268,Nonconforminglotsofrecord,describesrequirementsforthoselotsof <br />recordthatarenonconformingandrequirementsforthoselots,includingbringingthose <br />propertiesintocompliancewiththecode. <br />Subsection(a)currentlyrequiresanyͻƓĻǞuseorchangeinƚĭĭǒƦğƓĭǤͼbesubjectto <br />reviewbythePlanningDirectorincludingreviewofparking,loading,vehicularaccess, <br />landscaping,setbacks,utilityavailability,andotherrequirements.TheSubcommitteeis <br />recommendingthatthephaseͻƚƩchangeinƚĭĭǒƦğƓĭǤͼbestrickenfromthis <br />subsection.Thiswouldpreventthecityfromrequiringthosenonconforminglotsof <br />recordtocomeintocompliancewiththecodeandwouldallowthemtoremain <br />nonconforminguntilsuchtimeasanewuseisproposedonthesite.Someofthe <br />nonconformitiesthatstaffhastraditionallyreviewedinclude,butisnotlimitedto,the <br />reviewofparking,loading,vehicularaccess,landscaping,setbacks,utilityavailability, <br />andotherrequirements <br />Theproposedlanguagespecifieswhatitemsspecificallystaffcanreviewwhenthereisa <br />changeinuseonasite.StaffandtheSubcommitteeagreedthattheinclusionof <br />ͻƦğƩƉźƓŭlotsurfacingforrequiredparking,dumpsterĻƓĭƌƚƭǒƩĻƭͼtogoalongwiththose <br />itemsalreadyincludedinthissubsectionincludingrequiredparking,loading,vehicular <br />access,landscaping,setbacksandutilityavailability,provideforareasonablelistof <br />itemsstaffcanreview. <br />Section106310,CommercialandIndustrialUsesTable: <br />9.Asameanstoimproveaccesstoinformationforthosedevelopingbusinesses,the <br />Subcommitteeisrecommendingcombiningboththecommercialandindustriallanduse <br />tables(Sections106441and106521,respectively)andrelocatingthemtoanew <br />Section106310. <br />Inthecurrentversionofthecode,landusesintheCityofLaPortewerecategorized <br />throughtheStandardIndustryClassification(SIC)systemandtheindustrynumber <br />assignedtoindividualuses.TheSICwasadoptedin1987andtheUnitedStatesOfficeof <br />3 <br /> <br />
