PlanningandZoningCommissionRegularMeeting <br />November19,2015 <br />LaPorteTownCenterSCUP <br />114roomhotel <br />2acresofparkandwaterfeatures <br />Staffisrecommendinganumberofconditionsassociatedwithlanduseberequiredas <br />partoftheSCUP: <br />1.LandusesarepermittedinaccordancewiththeLaPorteTownCenterGeneral <br />Plan.Anymodificationstosuchplaninthefuturewillrequireconsiderationby <br />thePlanningandZoningCommission. <br />2.ApprovalofthisSCUPwouldallowforGeneralCommercialusesinthe <br />commercialarea,excludinganumberofusesthataremoreintensethan <br />retail/service/officeuses,includingautomotiverelated,generalcontractors,etc. <br />3.Thetownhousedevelopmentshouldbeconstructedinaccordancewiththe <br />provisionsofSection106333oftheCodeofOrdinances,whichoutlinesgeneral <br />requirementsfortownhousedevelopment.Anydeviationfromthese <br />requirementswouldrequireapprovalofavariancebytheBoardofAdjustment. <br />Theseunitswouldbesubjecttoallapplicablebuildingcoderequirementsforfire <br />rating. <br />4.Liveworkunitsareaconceptintendedtoprovideforbusinessesonthemain <br />floorandresidentialabove.Theliveworkunitsarepermittedsubjecttothe <br />setbackrequirementsoutlinedfordevelopmentintheMainStreetOverlay <br />District,whichstipulatesaЉfrontsetback,ЋЉrearsetback,andЉsidesetback. <br />Theseunitswouldbesubjecttoallapplicablebuildingcoderequirementsforfire <br />rating.Anydeviationfromtheserequirementswouldbesubjecttoapprovalofa <br />variancebytheBoardofAdjustment. <br />AdjacentDevelopment. <br />In2007,thecityapprovedaGeneralPlanfortheadjacenttractsoflandnorthandsouth <br />ofthesubjectsitecalledͻ\[ğƉĻƭatFairmontDƩĻĻƓƭͼ(seetheattachedExhibitF).The <br />developmentincludedvariousphasesofsinglefamilydetachedresidential <br />development.ThephasesdevelopedtothispointaretheDRHortonHomes <br />developmentatthesoutheastcornerofWhartonWeemsandHighway146and <br />BayshoreElementarySchoolatthenortheastcornerofMcCabeandHighway146. <br />Althoughcurrentlyundeveloped,theadjacentpropertiestothenorthandsouthofthe <br />subjectsitehavebeenidentifiedforsinglefamilydetachedresidential.Thisisalsocalled <br />outintheĭźƷǤƭFutureLandUsePlanapprovedintheComprehensivePlan.Although <br />thisdocumentcanbeamendedandlandusescanbechanged,weshouldplanforwhat <br />hasbeencontemplatedatthistimefordevelopmentofthoseparcels.Asaresult,the <br />developerisproposingtheinstallationofpublicroadsalongtheperimeterofthe <br />developmenttoprovideaccesstobothparcelsascontemplatedintheLakesat <br />FairmontGreensGeneralPlan.Additionally,staffisrecommendingthataconditionbe <br />consideredthatrequirestheapplicanttoinstallan8foothighmasonryfencewith <br />landscapingtoprovideabufferbetweenthisdevelopmentandanyfutureresidential <br />3 <br /> <br />
