EXHIBIT D <br />E.“Builder” means an individual or entity that purchases a single or multiple Lots from <br />the Declarant for the purpose of constructing Dwellings thereon, which Dwellings <br />will be offered for sale to purchasers. “Builder” shall not include an individual or <br />entity constructing additions onto a Dwelling already in existence, performing repairs <br />or maintenance or re-constructing or replacing a Dwelling after demolition or <br />destruction, either partial or complete. <br />F.“Bylaws” mean the Bylawsof the BaysideCrossingCommunity Association, Inc., as <br />they may be amended from time to time. <br />G.“Common Area” means all real property owned in fee or held in easement, lease, or <br />licenseby the Association for the common use and/or enjoyment of the Owners and <br />shall include areas designated by Declarant to be conveyed by deed or easement to <br />the Association. <br />H.“Community Wide Standard” means the standard of conduct, maintenance, or other <br />activity generally prevailing throughout the Subdivision. Such standards may be <br />defined in the Guidelines or rules and regulations. Such standards may be <br />specifically determined, and modified, by the Declarant at any time during the <br />Development Period, and thereafter by the Board and/or the ARC. <br />I.“Declarant” means Beazer Homes Texas, L.P., a Delaware limited partnership, its <br />successors and assigns as same may be evidenced by a written instrument recorded in <br />the real property records of the HarrisCounty Clerk’s office. <br />J."Development Period" means the period of time that Declarant reserves the right to <br />facilitate the development, construction and marketing of the Subdivision and the <br />right to direct the size, shape and composition of the Subdivision, which retained <br />rights shall be vested in the Declarant until Declarant no longer owns any portion of <br />the Property or such time as Declarant assigns or relinquishes all of its retained rights. <br />K.“Declaration” means this Declaration of Covenants, Conditions, and Restrictions for <br />Bayside Crossing, which encumbers the Property, andany other property brought <br />under the control of this Declaration, or any supplemental declaration, annexation <br />agreementand/or amendment thereto. <br />L.“Dedicatory Instruments” shall mean each document governing the establishment, <br />maintenance and operation of the Subdivision, including but not limited to the <br />Declaration, Bylaws, Certificate of Formation,and similar instruments governing the <br />administration or operation of the Association, as well as any and all rules, Guidelines <br />and policies, and any supplements or amendments to such documents, enforceable by <br />the Association. <br />M.“Deed Restriction Violation” means a condition on a Lot that does not comply with <br />the terms and conditions of all Dedicatory Instruments covering the establishment, <br />maintenance, and operation of the Subdivision.
