EXHIBIT D <br />particular Dwellingdoes not qualify as a Member in Good Standing, then all <br />Occupants of such Dwelling shall not be considered as Members in Good Standing. <br />Additionally, if an Owner of multiple Lots does not qualify as a Member in Good <br />Standing as to one Lot, then such Owner shall not qualify as a Member in Good <br />Standing as to all Lots owned by the Owner. <br />U."Occupant" shall mean residents, tenants, lessees, guests, and invitees of any Lot or <br />Dwelling within the Properties for any period of time. <br />V.“Outbuildings” shall mean and refer to structures such as (by way of example and not <br />limitation) storage buildings, sheds, greenhouses, gazebos and shade trellises. <br />W.“Owner” means an owner of any portion of the Property. Persons or entities holding <br />title only as a lienholder shall not be an Owner for purposes of this Declaration. <br />X.“Recreational Sites” means Common Area property that is set aside for use as <br />recreational facilities, reserves, or green space and is encumbered by this Declaration, <br />a recorded plat, or both. <br />Y.“Special Assessment” means an Assessment levied pursuant to the terms set forth <br />herein,for a specific purpose. <br />Z.“Supplemental Amendment” or “Annexation Agreement” shall mean an amendment <br />or supplement to this Declaration, executed by or consented to by Declarant which <br />subjects additional property to this Declaration and/or imposes, expressly or by <br />reference, additional restrictions and obligations on the land described therein. The <br />term shall also refer to the instrument recorded by the Declarant or the Association <br />pursuant to the provisionsof this Declaration to subject additional property to this <br />Declaration. <br />AA.“Subdivision,”the “Property,”and/or “Bayside Crossing” means the Bayside <br />CrossingSubdivision located in HarrisCounty, Texas. As of the date of this <br />Declaration, the Subdivision is more particularly described in the Plat. The <br />Subdivision may be supplemented as additional land is annexed into the Subdivision <br />by the recording of an Annexation Agreementor Supplemental Amendment. <br />ARTICLE II.PURPOSE AND INTENT <br />The Subdivision, as initially planned, is intended to be a single-family, residential <br />development that is planned to feature residential uses. This Declaration shall serve as the means <br />by which design, maintenance and use of the Property,and additional property made a part of the <br />Subdivision,will be established.
