PlanningandZoningCommissionRegularMeeting <br />September25,2014 <br />FutureLandUseMapAmendment <br />PlanningandDevelopmentDepartment <br />StaffReport <br />ISSUE <br />ShouldthePlanningandZoningCommissionrecommendapprovaltotheCityCouncilof <br />anamendmenttotheĭźƷǤƭFutureLandUsePlanamendingthelegaldescriptionas <br />depictedintheattachedExhibitAfromCommercialtoLargeLotResidential? <br />RECOMMENDATION <br />StaffrecommendsthePlanningandZoningCommissionrecommendapprovaltothe <br />CityCouncilofanamendmenttotheĭźƷǤƭFutureLandUsePlanamendingthelegal <br />descriptionasdepictedintheattachedExhibitAfromCommercialtoLargeLot <br />Residential. <br />DISCUSSION <br />StaffispresentingarequestforanamendmenttotheĭźƷǤƭFutureLandUsePlanasa <br />resultofaapplicationforarezoningofatractoflandownedbyJoeBerry(ownerof <br />11814N.PStreet)andJudyBerry(ownerof1502SensRoad).JudyBerryisproposingto <br />sella36.9footby100footsquared(3,690squarefeet)portionofherlottohersonJoe <br />Berry.TheattachedExhibitBshowstheproposedlotconfiguration.JoeBerryisseeking <br />topurchaseaportionofpropertyfromhismotherforthepurposeofconstructingan <br />accessorystructuretobeusedasastorage/workshoponthatportionofproperty.The <br />requestedrezonewouldalsoremovethenonconformingstatusofhisproperty,ashis <br />propertyiscurrentlyasinglefamilydetachedlargelotzonedGC,GeneralCommercial. <br />Section213.003oftheTexasLocalGovernmentCode(LGC)specifiesrequirementsfor <br />amendingtheĭźƷǤƭFutureLandUseMap,whichwasadoptedasacomponentofthe <br />ComprehensivePlan.TheLGCrequiresreviewoftheproposedamendmentbythe <br />PlanningandZoningCommissionandapprovalbytheCityCouncil.Apublichearingwill <br />bescheduledatthetimeofCityCouncilreview. <br />TheCityofLatƚƩƷĻƭLandUseMapcurrentlyidentifiesthisparcelascommercial.See <br />theattachedExhibitBidentifyingtheLandUseMapforthisarea;howevertheexisting <br />useofthesiteislargelotresidential.Asaresult,inordertorezonethepropertythe <br />ĭźƷǤƭLandUseMapwouldneedtobeamendedtoidentifythissiteasLargeLot <br />Residential. <br />1 <br /> <br />
