PlanningandZoningCommissionRegularMeeting <br />October30,2014 <br />VacatingPlatofReserve1ͻhƓƌǤͼofFairmontBusinessPark <br />PlanningandDevelopmentDepartment <br />StaffReport <br />ISSUE <br />ShouldthePlanningandZoningCommissionapprovetheproposed VacatingPlatofReserve1ͻhƓƌǤͼ <br />ofFairmontParkEastBusinessParkReserves1,3,4,5and6? <br />RECOMMENDATION <br />StaffrecommendsthePlanningandZoningCommissionapprovetheproposedvacatingplat(seethe <br />attachedExhibitA). <br />DISCUSSION <br />Thesubjectsite,knownasReserve1,ispartoftheFairmontParkEastBusinessParkReserves1,3,4, <br />5,and6subdivisionplat(seetheattachedExhibitC),whichspecificallyidentifiesallreservelots <br />withintheplatascommercialproperties.AttheJuly14,2014CityCouncilMeeting,theCouncil <br />approvedarequestforrezoningofReserve1fromGC,GeneralCommercial,toR1,LowDensity <br />Residential.Theapprovedordinancerequiredtheapplicanttosubmitandreceiveapprovalofa <br />ͻǝğĭğƷźƚƓofthatportionoftheexistingplatdesignatedasReserve1andapplicabletotheproperty <br />madethesubjectofthisƚƩķźƓğƓĭĻͶͼ(seetheattachedExhibitBforacopyoftheapproved <br />ordinance).Asaresulttheapplicant,EddieV.Gray,Trustee,hassubmittedapplicationforthe <br />requiredvacatingplat.Theproposedvacatingplatwillremovethecommercialrestrictiononthe <br />subjectparcelandallowfortheresidentialuse.Theapplicantwillalsoberequiredtoreplatthelotas <br />well,whichisprocessedasanadministrativeplatbutwillberecordedconcurrentlywiththevacating <br />plat. <br />ThevacatingofsubdivisionplatsoraportionofasubdivisionplatispermittedinSection212.013of <br />theTexasLocalGovernmentCode.Additionally,the/źƷǤƭDevelopmentOrdinance(No.1444) <br />containstheĭźƷǤƭrequirementsforavacatingplat,whichrequiresapprovalbythePlanningand <br />ZoningCommission.TheattachedExhibitDisSection4.05oftheDevelopmentOrdinancepertaining <br />totherequirementsofavacatingplat.Staffhasconductedareviewofthedocumentand <br />determinedthatitcomplieswiththeĭźƷǤƭrequirements. <br />ATTACHMENTS <br />ExhibitA:ProposedVacatingPlatofReserve1ͻhƓƌǤͼofFairmontBusinessParkReserves1,3, <br />4,5and6 <br />ExhibitB:OrdinanceNo.20143527 <br />ExhibitC:ExistingFairmontParkEastBusinessParkReserves1,3,4,5,and6SubdivisionPlat <br />ExhibitD:Section4.05oftheDevelopmentOrdinance(No.1444) <br />ExhibitE:AreaMap <br />1 <br /> <br />
