If an agreement can’t be reached within a <br />reasonable time on the amount of any proposed increases, the City shall have the right <br />to cancel the purchase and terminate this agreement. <br />5.Appropriation Updates: The City of La Porte agrees to give Sutphen Corporation an <br />annual update on or about October 1 of each year during the term of this agreement <br />when acquisition of another pumper is intended to allow Sutphen time to properly <br />project the purchases of the numerous expensive components like the Cummins motor, <br />Hale fire pump etc. as outlined in the accepted Sutphen proposal. <br />6.Term: This agreement shall become effective when approved by the La Porte City <br />Council and shall expire after City has elected to purchase a fifth Heavy Duty Sutphen <br />“Shield 2” pumper, pursuant to this agreement, if not sooner terminated under Section <br />7 of this agreement. <br />7.Termination: Either party has the right to terminate this Memorandum of Agreement <br />at any time without obligation for future purchases by giving ninety (90) days written <br />notice to the other party. <br />For City of La Porte, TX:For Sutphen Corporation: <br />Steve Gillett, Interim City Manager Sutphen Corp./Title <br />Date <br />Date <br /> <br /> <br />
