PARTI-CHARTER <br />CHARTER COMPARATIVE TABLE <br />8.01. - Publicity of records. <br />8.02. - Employers and officers <br />8.03. - Assignment, execution and garnishment of city property. <br />8.04. - City not required to give security or execute bond <br />8.05. - Effect of this Charter on existing law. <br />8.06. - Amending this Charter. <br />8.07. - Severability clause <br />8.08. - References to laws. <br />8.09. - Approval of this Charter. <br />8.10. - Provisions for transition <br />8.01. - Publicity of records. <br />All records and accounts of every office, department or agency of the city shall be open to inspection by <br />any person, any representative of a citizen's organization or any representative of the press during <br />normal business hours, as provided in the Texas Open Records Act, V.T.C.A., Government Code § <br />552.001 et seq. <br />State law reference— Public records act, V.T.C.A., Government Code § 552.001 et seq. <br />8.02. - Employers and officers. <br />a. Personal financial interest. No member of city council or any officer or employee of the city shall <br />have a financial interest, direct or indirect or by reason of ownership of stock in any corporation, in any <br />contract or in the sale to the city, or to a contractor supplying the city, of any lands or rights of interests <br />in any land, material, supplies or service. Any willful violation of this section shall constitute <br />malfeasance in office, and any officer or employee of the city found guilty thereof shall thereby forfeit <br />his office or position. Any violation of this section with the knowledge expressed or implied of the <br />person or corporation contracting with the city shall render the contract voidable by council. <br />b. Employment interest. No one who has been elected to city office shall be employed in a <br />nonelective office by the city within the term for which he was elected or for one year thereafter. <br />c. Nepotism. No person related, within the second degree by affinity or within the third degree by <br />consanguinity, to the mayor or any councilperson or to the city manager shall be employed or <br />appointed to any office, position or clerkship of the city. This prohibition shall not apply, however, to any <br />person who shall have been employed for two (2) years or more by the city at the time of the election or <br />appointment of the officer to whom he is related. <br />d. Bonds. Council shall require bonds of all municipal officers and employees who receive or pay out <br />any monies of the city. The amount of such bonds shall be determined by council and the cost thereof <br />borne by the city. Council shall set the bond amount for the city manager and the director of finance at <br />an amount not less than ten thousand dollars ($10,000.00). <br />e. Oath of office. <br />1. Elected officers. Every elected officer of the city shall, before entering upon the duties of his <br />office, take and subscribe to the following oath or affirmation, to be filed and kept in the office of <br />the city secretary: <br />"I, <br />office of <br />do solemnly swear (or affirm), that I will faithfully execute the duties of the <br />of the City of La Porte, State of Texas, and will to the best of my <br />Page 28 of 32 La Porte, Texas, Code of Ordinances <br />
