PARTI- CHARTER <br />CHARTER COMPARATIVE TABLE <br />such actions, suits, appeals or proceedings, same shall be conducted in the same manner as if such <br />bond, undertaking or security had been given as required by law, and said city shall be as liable as if <br />security of bond had been duly executed. <br />8.05. - Effect of this Charter on existing law <br />All ordinances, resolutions, rules and regulations now in force under the city government of the city and <br />not in conflict with the provisions of this Charter shall remain in force under this Charter until altered, <br />amended or repealed by city council after this Charter takes effect; and all rights of the city under <br />existing franchises and contracts are preserved in full force and effect to the city, and any unissued <br />bonds and revenue bonds, or installments thereof, heretofore authorized at an election held in said city <br />shall not be affected by the adoption of this Charter, but the right to sell, issue and deliver same, in <br />whole or in part, in keeping with the provisions of the laws under which they were voted is hereby <br />expressly reserved. <br />8.06. - Amending this Charter. <br />a. Amendments may be proposed and submitted to the electors of the city by ordinance passed by a <br />majority vote of the full membership of city council or by a petition signed by qualified voters of the city <br />in number not less than five (5) per cent thereof or twenty thousand (20,000) signatures, whichever is <br />less. Such petition shall in all other respects conform to the provisions of Article VI. <br />When a properly drawn petition has been duly filed, council shall provide by ordinance for submitting <br />such proposed amendments to a vote of the electors at an election to be held not less than thirty (30) <br />days nor more than ninety (90) days after the passage of said ordinance. If the next regular municipal <br />election is to be held during said period, the submission of said amendment or amendments shall be at <br />such election. Otherwise, a special election shall be called for the purpose. Notice of the election shall <br />be given by publication thereof in the official newspaper on the same day in each of two (2) successive <br />weeks; the date of the first publication to be not less than fourteen (14) days prior to the date set for <br />said election. The form of such notice shall be as prescribed by this Charter, including a substantial <br />copy of the proposed amendment or amendments. <br />Each amendment submitted shall contain only one subject and shall be printed separately on the ballot, <br />each proposed amendment being followed by designations for the voter to vote for the amendment or <br />against the amendment. <br />Each proposed amendment, if approved by the majority of the qualified voters voting at said election, <br />shall become a part of the Charter. The city secretary shall enter notice into the records of the city <br />declaring the same adopted. <br />b. This section is subject to the provisions of V.T.C.A., Local Government Code §§ 9.04 and 9.05, <br />and V.T.C.A., Election Code § 41.001 et seq. <br />8.07. - Severability clause. <br />If any section or part of section of this Charter shall be held invalid by a court of competent jurisdiction, <br />such holding shall not affect the remainder of this Charter nor the context in which such section or part <br />of section so held invalid may appear, except to the extent that an entire section or part of section may <br />be inseparably connected in meaning and effect with the section or part of section to which such <br />holding shall directly apply. <br />Page 30 of 32 La Porte, Texas, Code of Ordinances <br />
