iii. 4.01 (D) Official General Plan <br />The code states that an approved general plan expires after one year if a plat <br />has not been filed and upon written notice to the subdivider. This potentially <br />creates a gray area if the city fails to send the written notice. The general plan <br />should simply expire after one year without notice. Further, this section allows <br />the subdivider to request a one-year extension, but does not stipulate if the <br />extension is automatically approved or if the Commission needs to act to <br />approve the request. <br />iv. 4.03 (C) Preliminary Plats: Effect of Approving Authority Action <br />The code states that an approved preliminary plat expires after one year if a <br />final plat has not been filed and upon written notice to the subdivider. This potentially creates a gray area if the city fails to <br />send the written notice. The final plat approval should simply expire after one <br />year without notice. Further, this section allows the subdivider to request a <br />one-year extension, but does not stipulate if the extension is automatically <br />approved or if the Commission needs to act to approve the request. <br />Additionally, an alternative should be provided to allow the subdivider to submit <br />a performance bond for completion of the public improvements if they wish to <br />record the plat before the public improvements are completed. <br />vi. 5.01 General Street Standards <br />Table 5-2 (Street Geometric Design Standards) should be moved to the Public <br />Improvement Criteria Manual. <br />vii. 5.01 (J) Alleys <br />The City should consider the practice of continuing to allow new alleys to be <br />platted. Based on the prior complications and cost of maintaining alleys, the <br />provision of alleys, at a minimum, should be at the discretion of the City rather <br />than the developer. <br />viii. 5.04 Building Lines <br />The building line requirements in this section should be consolidated into the <br />Zoning Ordinance to avoid conflicts and the need to cross-reference multiple <br />locations to find the same information.
