6. LA PORTE shall arrange for all supplies and voting equipment for the Election, including <br />but not limited to, official ballots, sample ballots, voter registration lists, and all forms, <br />signs, maps and other materials used by the election workers and judges at the voting <br />location. <br /> <br />7. FIRE DISTRICT agrees to appoint Patrice Fogarty as Election Administrator and Sharon <br />Harris as the Early Voting Clerk, Barbara Matuszak as Presiding Judge, and Hector <br />Villarreal as Alternate Presiding Judge. The La Porte City Secretary's election office in <br />La Porte City Hall is hereby designated as the Central Counting Station to receive all ballots <br />cast at the Election, and Sharon Harris is hereby appointed the Presiding Manager for said <br />Central Counting Station. Said Presiding Manager shall appoint any clerks necessary to <br />assist in receiving ballots and other records and in performing the other duties of said <br />Presiding Manager in this regard. Martha Gillett is hereby appointed as the Presiding <br />Judge of the Central Counting Station, and Jana Wood is hereby appointed as Alternate <br />Presiding Judge for said Central Counting Station. The Election Administrator is hereby <br />authorized and directed to obtain, or cause to be obtained, the necessary electronic <br />tabulating equipment, to arrange for the testing thereof as provided by law and to employ a <br />duly qualified manager and a duly qualified tabulation supervisor to perform the duties <br />respectively imposed on them by law with respect to the processing and tabulation of <br />ballots at the Central Counting Station. Norma Repman is hereby appointed the tabulation <br />supervisor. FIRE DISTRICT shall appoint an Early Voting Ballot Board (EVBB) to <br />process early voting results from the Election. The Presiding Judge, with the assistance <br />of the Election Administrator, shall appoint two or more additional members to constitute <br />the EVBB. The Election Administrator shall determine the number of EVBB members <br />required to efficiently process the early voting ballots. Peggy Holland is hereby appointed <br />as judge of the Early Voting Ballot Board. <br /> <br />8. This Agreement is subject to the approval of the La Porte City Council on behalf of <br />LA PORTE and the Board of the FIRE DISTRICT. This Agreement shall be effective <br />immediately at the time of its passage and approval by both parties hereto, and said <br />Agreement shall expire June 1, 2016. <br /> <br />9. Nothing herein shall be construed as creating any personal liability on any part of any <br />officer or agent of any public body that may be a Party hereto. The Parties agree that no <br />provision of this Agreement is in any way intended to constitute a waiver of any <br />immunities from suit or liability that any Party may have by operation of law. The Parties <br />further agree that no provision of this Agreement extends the liability of any Party <br />beyond the liability provided in the Texas Constitution and the laws of the State of <br />Texas. Neither the execution of this Agreement nor any other conduct of any Party <br />relating to this Agreement shall be considered a waiver of any right or defense under the <br />Texas Constitution or the laws of the State of Texas. <br /> <br /> <br /> <br /> <br /> 2 <br /> <br />
