WASTEWATER TREATMENT AGREEMENT <br />(CITY CUSTOMER AGREEMENT) <br />This Agreement is made and entered into on this ____ day of ________, 2019, ( <br />GCAlocal government and body politic and corporate of the State of Texas, <br />and the City of La Porte, a home-ruled municipality of the State of Texas (the City <br />W I T N E S S E T H: <br />Recitals <br />WHEREAS, GCA is a conservation and reclamation district created pursuant to the provisions of Article <br />XVI, Section 59 of the Texas Constitution and, by virtue of its enabling legislation and the laws of the State of <br />Texas, is duly authorized and empowered to enter into certain agreements with public and private entities <br />regarding treatment and disposal of wastes of municipal and industrial origin; and <br />WHEREAS, GCA owns and operates a waste treatment facility known as the Bayport Wastewater <br />Treatment Facility at 10800 Bay Area Boulevard in Pasadena, Texas; and <br />WHEREAS, the City desires to transport domestic sewage to the Treatment Facility for treatment; and <br />WHEREAS, Chapter 791 of the Texas Government Code provides that a municipality may contract with <br />a conservation and reclamation district to obtain wastewater treatment services; and <br />WHEREAS, subject to the terms and conditions of this Agreement, GCA is willing to accept and treat the <br />City's domestic sewage and discharge the resulting treated effluent at the Treatment Facility in accordance with <br />all federal, state, and local rules and regulations. <br />Agreement <br />Now, therefor, for and in consideration of the premises and the mutual promises, covenants, obligations, <br />and benefits hereinafter set forth, GCA and the City hereby agree as follows: <br /> <br />I. <br />Delivery and Treatment of Wastewater <br />1.01. The wastewater the City collects and transports to GCA's Treatment Facility shall be normal <br />domestic sewage or normal municipal wastewater ("Domestic Sewage/Municipal Waste"), which means a <br />combination of the water-carried wastes from residences, businesses, and buildings and institutions, together with <br />such infiltration water as may be present.
