February 9, 2021 <br />Texas Specialized Construction Services, LLC <br />16107 Kensington Dr. Suite 123 <br />Sugar Land, TX 77479 <br /> <br />Mr. Millis, <br /> <br />As you are aware, Texas Specialized Construction Services, LLC (TSC) was awarded the contract for 5 Points <br />Plaza Enhancements on December 16, 2020, by the City of La Porte. As of this date, we have not received <br />the original Performance and Payment Bonds needed for the completion of this contract, despite requests <br />for same from my office. <br /> <br />According to Article 15 of the Instruction to Bidders document, when the successful Bidder delivers the <br />executed Agreement to the Owner, it shall be accompanied by the required bonds. Also, in Article 16 <br />“Signing of Agreement” of the instructions to Bidders document, it states, “Within 15 days thereafter, <br />Contractor shall sign and deliver the required number of counterparts of the Agreement and attached <br />documents to Owner with the required bonds and certificated or policies of insurance” <br /> <br />TSC was given an extension until February 1, 2021, via email correspondence, to submit the required <br />bonds, but as noted, as of the date of this letter the bonds have not been received by the City of La Porte. <br /> <br />The City wishes to commence construction on this project without unnecessary delay. Therefore, a <br />recommendation will be made to City Council at the February 22, 2021, City Council meeting to terminate <br />the agreement with TSC due to TSC’s failure to meet the conditions of the contract and to award the <br />contract to the next lowest bidder. <br /> <br /> <br />Best Regards, <br /> <br /> <br />Cherell Daeumer, CPPB <br />Purchasing Manager <br /> <br /> <br /> <br />
