<br />construction budget per Activity until completion and acceptance by the GLO of
<br />all actions and Deliverables for the Activity, as identified in Attachment A.
<br />The GLO shall make the final disbursement to Subrecipient only upon the GLO's
<br />receipt and acceptance of the Deliverables identified in Attachment A as required
<br />for the completion of construction phase.
<br />If Subrecipient has multiple construction subcontracts, an amount equal to five
<br />percent (5%) of Subrecipient's construction budget per construction subcontract
<br />shall be withheld by the GLO until completion and acceptance by the GLO of all
<br />actions and Deliverables identified in Attachment A for the particular project.
<br />Separate Deliverables are required per construction subcontract, and associated
<br />costs are pro -rated in accordance with budget details in the final GLO-approved
<br />Application. If a project includes more than one Environmental Review Record,
<br />associated costs are pro -rated in accordance with budget details in the final GLO-
<br />approved Application.
<br />(b) Project Delivery — Grant Administration
<br />To ensure full performance of this Contract, the GLO has set aside an amount
<br />equal to five percent (5%) of Subrecipient's project delivery — grant
<br />administration budget until completion and acceptance by the GLO of all actions
<br />and Deliverables identified in Attachment A.
<br />ARTICLE VI - INTELLECTUAL PROPERTY
<br />6.01 OWNERSHIP AND USE
<br />(a) The Parties shall jointly own all right, title, and interest in and to all reports, drafts
<br />of reports, or other material, data, drawings, computer programs and codes
<br />associated with this Contract, and/or any copyright or other intellectual property
<br />rights, and any material or information developed and/or required to be delivered
<br />under this Contract, with each Parry having the right to use, reproduce, or publish
<br />any or all of such information and other materials without obtaining permission
<br />from the other Parry, subject to any other restrictions on publication outlined in
<br />this Contract, and without expense or charge.
<br />(b) Subrecipient grants the GLO and HUD a royalty -free, non-exclusive, and
<br />irrevocable license to reproduce, publish, or otherwise use, and to authorize others
<br />to use, for U.S. Government purposes, all reports, drafts of reports, or other
<br />material, data, drawings, computer programs, and codes associated with this
<br />Contract, and/or any copyright or other intellectual property rights, and any
<br />material or information developed and/or required to be delivered under this
<br />Contract.
<br />6.02 NON -ENDORSEMENT BY STATE AND THE UNITED STATES
<br />Subrecipient shall not publicize or otherwise circulate promotional material (such as
<br />advertisements, sales brochures, press releases, speeches, still or motion pictures, articles,
<br />manuscripts, or other publications) that states or implies the GLO, the State of Texas,
<br />U.S. Government, or any government employee, endorses a product, service, or position
