<br />Smoking Regulations <br /> <br />Page 4 <br /> <br />CURRENT CITY REGULATIONS <br /> <br />DIVISION 2. SMOKING* <br /> <br />Sec. 34-51. Definitions. <br />The following words, terms and phrases, when used in this division, shall have the meanings <br />ascribed to them in this section, except where the context clearly indicates a different meaning: <br />Employee means a person who is employed by an employer in consideration for monetary <br />compensation or profit. <br />Employer means a person, partnership, corporation, association or other entity that employs one <br />or more persons. <br />Place of employment means an enclosed, indoor area under the control of an employer to which <br />employees have access during the course of employment, and includes work areas, employee <br />lounges, employee restrooms, conference rooms and employee cafeterias. The term does not <br />include a private residence. <br />Public meeting means a meeting open to the public and held in an enclosed area unless the <br />meeting is held in a private residence. <br />Public place means an enclosed, indoor area where individuals commingle to engage in <br />commerce, recreation, educational activities or transportation, and includes: <br />(1) Allor part ofa building used for state or local governmental purposes; <br />(2) A retail store, office or other commercial establishment; <br />(3) A grocery store; <br />(4) A restaurant or cafeteria; <br />(5) Public school facilities; <br />(6) A school bus; <br />(7) A health care facility including, but not limited to, laboratories associated with the rendition <br />of health care treatment, hospitals, nursing homes and doctors' and dentists' offices; <br />(8) A theater, movie house, gymnasium, museum, auditorium, convention center or arena; <br />(9) A public means of mass transportation, including associated terminals; <br />(10) A courtroom; <br />(11) A jury waiting or deliberation room; <br />(12) A library; <br />(13) A place of employment; <br />(14) A place providing personal services; <br />(15) A service line, cashier area, over-the-counter sales area, or common traffic area; <br />(16) An elevator; <br />(17) A hotel or motel; <br />(18) A restroom; or <br />(19) Any area or building in which smoking is prohibited by state law. <br />
