Correction or withdrawal of bids, and/or cancellation of ~wards: Correction or <br />withdrawal of inadvertently erroneous. bids before or after bid opening, or cancellation <br />of awards or contracts based on such bid mistakes, may be' permitted where <br />appropriate. Mistakes discovered before bid opening may be modified or withdrawn <br />by written notice received by the office designated in the invitation for bids prior to the <br />time set for bid opening. After bid opening, corrections in bids shall be pennitted only <br />to the extent that the bidder can show by clear and convincing evidence in writing <br />that a mistake, of a nonjudgmental character was made and the nature of the <br />mistake. <br /> <br />After bid opening, no changes in bid prices or other provisions of bids prejudicial to <br />the interest of the City or fair competition shall be permitted. In lieu of bid correction, <br />a low bidder alleging a material mistake of fact may be permitted to withdraw their bid <br />if: <br />A. The mistake is clearly evident on the face of the bid document but the <br />intended correct bid is not similarly evident; or <br /> <br />B. The bidder submits evidence which clearly and convincingly demonstrates that <br />a mistake was made. All decisions to permit the correction or withdrawal of <br />bids, or to cancel awards or contracts based on bid mistakes, shall be <br />supported by written determination made by the Purchasing Agent. <br /> <br />6. Price discrepanciAs: In the event the unit price submitted on the bid, multiplied times <br />the estimated quantity, does not match the total price submitted, the unit price shall <br />prevail. <br /> <br />, .. <br />SECTION 5 - COMPETITIVE SEALED PROPOSALS <br /> <br />1. Competitive sealed proposals shall be utilized as provided for in Chapter 252 of the <br />Local Government Code, Vernon's Texas Codes Annotated. <br /> <br />2. The City may use the Competitive Sealed Proposals procedure only for high <br />technology procurements. <br /> <br />. 3. Late proposals, late withdrawals, and late modifications shall have the same <br />provisions as stated above under Competitive Sealed Bids. <br /> <br />4. Competitive Sealed Proposals shall be used when: <br />~ Oral or written discussions are necessary with offerors concerning technical and <br />price solutions <br />~ It is advantageous to afford offerors an opportunity to revise their offer prior to <br />award in order to consid.er best and final offers <br />~ Price is not the sole consideration for award <br />~ Comparative analysis of different technical solutions must be made <br /> <br />13 <br />
