*Article XII. General Provisions*
<br />Section 118. Publidty of records:
<br />All records and accounts of 'every office, department or
<br />agency of the city shall be open to inspection by any citizen,
<br />.any representative of a citizen's organization or 'any repre-
<br />sentative of the press at all reasonable times and - udder rea-
<br />monable' regulations established by the commission.
<br />Section 119. Personal interest.
<br />No member of the commission or any officer o_r employe&,
<br />of . th1e city shall have a financial interest,' -direct or indirect
<br />,or by reason of ownership of stock in any corporation, in any
<br />contract, or in the sale to the city, or to a contractor supply-
<br />ing the city, of any lands or rights of interests in any land,
<br />material, supplies, or service. Any wilful violation of this
<br />section shall constitute malfeasance in office, and any officer
<br />or employee of the city found guilty thereof shall thereby
<br />forfeit his- office or position. Any violation of this section
<br />with the knowledge expressed or implied of, the person or cor-
<br />poration contracting with the city shall render the contract
<br />voidable by the commission. (As amended, August 23, 1969) .
<br />Section 120. Oath of office.
<br />Every officer of the city shall, before entering upon the
<br />duties of his office, take and subscribe to the following oath
<br />.or affirmation, to be filed and kept in the office of the city
<br />clerk:

<br />affirm), that I will faithfully execute the.duties of the office
<br />Of _--- —----- ---------------------------- ---------- of - the City of La Porte,'
<br />State of Texas, and will to the best of my ability preserve,
<br />protect and defend the constitution and laws of the United
<br />States and of this state and the charter and ordinances,
<br />of this city; and I furthermore solemnly swear (or affirm),
<br />that I have not directly or indirectly paid, offered,'or proms
<br />ised to contribute any money, or valuable thing, or promised
<br />any public office or employment, as a reward for the giving
<br />or withholding a vote at the election at which I was elected,
<br />or if .the office is one of appointment, to secure my ap-
<br />pointment. So help me God."
<br />Section 121. Bonds; discharge of officers and employees.
<br />The commission shall require a bond from each officer of
<br />the city and may require bond from any city employee in
<br />amounts to be fixed by the commission. The commission shall
<br />be authorized to discharge at any time, with ' or without a
<br />hearing, as the commission may elect, any officer, employee
<br />or clerk• which it appoints.
<br />',Section 122. Public library.
<br />The commission shall have the authority to establish and
<br />maintain a free public library within the city and to cooperate
<br />with any person, firm•, association or corporation under such
<br />terms as the commission may prescribe for the establishment
<br />of such free public library. For budget purposes, the library
<br />shall be considered as a department of the city and the appro-
<br />priations therefor shall comply with all' the budgetary re-
<br />quirements. as outlined in this charter - and as may be
<br />prescribed from time to time by the commission. Annual ap-
<br />propriations for the library will not be continuing, but *ill
<br />revert to thegeneral fund in the same manner as the under -
<br />spent appropriations of the other departments.
<br />Section 123. Hospital; operation of.
<br />The' city shall have the authority to acquire, establish and
<br />own, either by purchase, donations, bequest or otherwise all
<br />property that may be useful or necessary for the purpose of
<br />establishing and maintaining a municipal hospital. Such hos-
<br />pital shall be operated by a hospital board, subject only to
<br />such. direction and supervision as shall be contained in any
<br />ordinance or ordinances duly enacted by the governing .body
<br />of said. city.
<br />Section 124. Hospital; finances.
<br />All funds belonging to said hospital, whether classed as
<br />funds received' in course of operation, or otherwise, shall be
<br />kept in a separate hospital fund, and shall be used only for
<br />the operation and maintenance of said hospital arid -Jar no
