Section 12� _. . __ <br />9. Disabled employees;_ . pensions, ineurance. <br />. The commission shall have authority to provide the rules <br />and regulations for maintaining employees when injured and 4 <br />disabled while 'performing their duties, or it may provide <br />for such plan of insurance as it deems .proper. The Commis- <br />sion may establish a pension .plan for anv emnlnveo w%n <br />has been continuously employed by tie city for twenty (205. <br />years and who shall have reached the age of fifty-five (55)., <br />or may adopt in lieu thereof' any pension system avhilable tw . <br />cities under. state law. The amount of said pension shall be <br />graded and proportioned to the average salary received by the - <br />employee during the whole period of his employment. All <br />those falling under the head of employees in this charter and <br />who are employed by the city when the same takes effect ' <br />shall be entitled to a credit for the years of continuous service <br />heretofore served. Provided however that any payment under <br />this provision shall never constitute a waiver or stop the <br />city from- asserting any defenses it might have under section <br />5, of Article I of this charter. <br />Section 130, Effect of this charter on existing law. <br />All ordinances, resolutions, rules and regulations no' w in <br />force under the city government of the City of La Porte and <br />-not in conflict with the provisions of this charter shall remain <br />in force under this charter until. altered, amended or repealed <br />by the commission after this charter takes effect; and all <br />rights of the City of La Porte under -existing franchises and <br />contracts are preserved in full force and effect to the City of <br />La Porte, and any unissued bonds and revenue bonds, or in- <br />stallments thereof, heretofore authorized at an election held <br />in said city -shall not be affected by the adoption of this char- <br />ter, but -the right to sell, issue, and deliver same, in whole or <br />in part, in keeping -with the provisions of the laws under <br />which they were voted is hereby expressly reserved. <br />Section 131. Interim municipal government. <br />From and after the date of the adoption of this charter <br />and.until the completion of the first election under this charter <br />to be held on the fourth Tuesday in April, A. D. 1950, and <br />the qualification of the mayor and commissioners therein <br />elected, the present qualified and acting mayor and two (2) <br />present qualified and acting commissioners shall constitute <br />the commission of the City of La Porte. Such commission shall . <br />possess all of the powers provided by this charter and pat- <br />ticularly by Article II hereof. <br />Section 132. Amending the charter. <br />Amendments to this charter may be framed and submitted <br />to the electors of the city by ' a charter commission in the <br />manner provided by law for framing and *submitting a new <br />charter. Amendments may also be proposed and submitted <br />by ordinance, passed by a majority vote of the full member- <br />ship of the commission, or by a petition signed by not ledge <br />than twenty-five per cent (2591, ) of the number of those <br />who voted at the last regular municipal election, provided, <br />however, that in the latter case the .petition must bear the <br />signatures of at least ten per centum (107o) of the qualified <br />voters of the city. When a charter amendment petition shall <br />have been filed with the commission in conformity with the <br />provisions of this charter as to petitions for initiated ordi- <br />nances, the commission shall forthwith provide by ordinance <br />for ;submitting such proposed amendments to a vote of the <br />electors. Any ordinance for submitting a charter amendment <br />to the electors shall provide that such amendment be sub- <br />mitted at the next regular municipal election if one shall <br />occur not less than sixty (60) days nor more than one hun- <br />-dred and twenty (120) days after 'the passage of the •or - <br />1, <br />
