Hon. Mayor, et.al - 2 <br />July 9, 1968 <br />"The power to fix the boundary limits of said <br />City, to provide for the extension of said <br />boundary limits and the annexation of additional <br />territory lying adjacent to said City, according <br />to such rules as may beprovided by City charter." <br />In 1963, the 58th Legislature enacted what is known as the' <br />Municipal Annexation Act, codified as Article 970a, Revised <br />Civil Statutes, which made sweeping changes in the procedures <br />to be followed by all Texas cities in annexing additional <br />territory. <br />The same Act amended subdivision 2 of Article 1175, which now <br />reads as follows, to -wit: <br />"2. The power to fix the boundary limits of said <br />City, to provide for the extension of said boundary limits, <br />and the annexation of additional territory lying adjacent to <br />said City, provide for the disannexation of territory within <br />such City, and to provide for the exchange of territory with <br />other cities or towns, according to such rules as may be pro- <br />vided by said charter not inconsistent with the procedural <br />rules prescribed by the Municipal Annexation Act." <br />In the absence of any amendment to Section 10 of the Home Rule <br />Charter of the City of La Porte, the annexation of additional <br />territory to the City would prevent procedural difficulties and <br />complications. In order to assure the validity of any such <br />annexation, it would be necessary to attempt to comply fully <br />with both the provisions of Section 10 of the present Home Rule <br />Charter of the City, and the provisions of Article 970a, <br />Municipal Annexation Act. <br />Therefore, I recommend that the provisions of Section 10 of the <br />Home Rule Charter be amended to hereafter read as follows. Such <br />amendment would also give the City the power of disannexation, <br />which was provided in the amendment of Article 1175, which power <br />is not contained in the present Home Rule Charter of the City of <br />La Porte: <br />"Section 10. Extension and Contraction of Boundary <br />Limits <br />"The Commission shall have power by ordinance to fix <br />the boundary limits of the City of La Porte and to <br />provide for the extension of said boundary limits <br />and the annexation of additional territory lying <br />adjacent to the City, to provide for the disannexation <br />
