Askins <br />City of La Porte <br />Page 2 <br />12-27-74 <br />The streets and alleys which, Chemetron requests the City of <br />La Porte vacate in order to render the foregoing project <br />economically feasible include portions of 17th Street, West <br />"H" Street, and West "G" Street, and certain alleys which run <br />parallel to 17th Street. Each of these streets and alleys <br />exist on the "subject tract" described above and will be more <br />fully described in Chemetron's Application for Vacation, Aban- <br />donment and Closing of Streets and Alleys. <br />Antimony Oxide is a chemical fire retardant which has proven <br />to be a significant factor in fire safety. Although not planned <br />to be constructed on the "subject tract" and thus not necessi- <br />tating the vacating of any streets or alleys, Chemetron has <br />definitive plans to erect a plant to manufacture a special <br />monomer to be used as an Occupational Safety and Health Act <br />approved glass substitute and an additional fire retardant <br />plant. <br />It is presently contemplated that these construction plans will, <br />barring unforeseen difficulties and assuming the Application <br />• for Vacation is granted, be pursued within a maximum of three to <br />five years. Approximately twenty per cent (20~) of the proposed <br />capital expenditures are currently under construction or will be <br />commenced in 1975. <br />In connection with this Application, Chemetron will agree not <br />to manufacture Phosgene on the "subject tract" heretofore <br />described. Additionally, Chemetron will agree to pay the usual <br />and reasonable cost for an eight (8) inch water line (sufficient <br />to provide reasonable fire protection) to extend from the inter- <br />section of "J" Street (Fairmont Parkway) and 16th Street to the <br />intersection of "H" Street and 16th Street. <br />To enable the City of La Porte to have pre-construction notice <br />of any proposed Chemetron expansion or construction projects, <br />Chemetron will agree to advise the City of La Porte of all con- <br />struction and operation applications filed with State and <br />Federal environmental regulation agencies or boards. It is <br />believed that this procedure would give the City advance notice <br />of Chemetron's plans/projects and would allow the City to deter- <br />mine the need, if any, to exercise its police power in a regula- <br />tory fashion and an opportunity, if desired, to oppose said <br />application before the appropriate regulatory agency or board. <br /> <br />
