Ball for Quitclaim <br /> from City of La Porte <br /> Dear Mayor Kibodeaux: <br /> I have been requested by Knox Askins, City Attorney for the City <br /> . of La Porte, to render an opinion regarding the request of Mr. <br /> James F. Ball for a quitclaim deed from the City of La Porte as <br /> to the captioned properties. <br /> A tax suit was filed against C. S. Penfield and C. E. Hunn to <br /> foreclose a tax lien in favor of the City of La Porte on April 28, <br /> 1923. The delinquent years were 1918 through 1922. Judgment was <br /> rendered in favor of the City of La Porte after service of citation <br /> by publication on September 20, 1923. Subsequently, on December <br /> 4, 1923, sale was held and the property was bought in by the City <br /> of La Porte for $153.77. The record shows no deed out of the city <br /> since then. Apparently the State of Texas, County of Harris and <br /> the La Porte Independent School District were not impleaded in the <br /> 1923 suit and have no interest in this property stemming from the <br /> judgment entered in this case. <br /> The delinquent tax records of the City of La Porte show no taxes <br /> due. On May 2, 1973, Ruth Huddleston, assistant tax collector for <br /> the City of La Porte, issued a certificate showing no unpaid taxes <br /> up to and including the year 1972 against Lots 6 through 21, Block <br /> 185, La Porte.
