Box 1218 <br />LaPorte, Texas 77571 <br />Dear Knox: <br />As we discussed by telephone today, Entex, Inc. wants to put <br />into effect under bond the gas utility-rates it has filed in <br />the current rate case with•the City of LaPorte.-.Since ninety --- <br />• days have elasped since we suspended those rates on May 5 by <br />Ordinance No. 1073, Entex is entitled to put those rates into <br />effect under Section 43(e) of Art. 1446(c), a copy of which is <br />. enclosed. <br />As you will note in Section 43(e), the bcnd must be with sureties <br />approved by the City Commission and must be conditioned upon <br />refund after determination is made of the proper rates. Therefore, <br />you will want to examine the bond and obtain City Commission - <br />approval of it. . <br />I expect Touche, Ross to complete their accounting analysis of - <br />Entex's proposed rates for LaPorte within two weeks, and to <br />negotiate with Entex,an appropriate rate schedule for presentation <br />to. the City Commission on August 31.
