Box 1115 <br />La Porte, Texas 77571 <br />Ladies and Gentlemen: <br /> <br />September 9, 1977 <br />Entex, Inc. (Entex) filed its Statement of .Intent to <br />Change Rates with the City of La Porte (City) on March 30, <br />1977. Subsequently, you entered on a hearing at which <br />evidence was presented by Entex in support of the proposed <br />change; you approved a Bond permitting Entex to collect <br />its proposed rates, subject to refund, pending a final <br />determination of the rate case; and finally, you denied <br />Entex any increase in rates. Entex filed its Petition for <br />Review of the City's action with the Railroad Commission of <br />Texas (Commission) on September 7, 1977. <br />Entex and the City were unable to reach agreement with <br />respect to the proper level of rates because, inter alia, of <br />certain provisions of a Proposal for Decision published in <br />Entex's Beaumont rate case, docketed as GUD N0. 710 at the <br />Commission. Both the City and Entex recognize that, whatever <br />the outcome of the Beaumont case at the Commission, the case <br />may be appealed to the courts, and that the final determina- <br />tion, at the Commission or in the courts, of the Beaumont <br />case may have some effect on the disposition of certain <br />issues in the Entex - La Porte rate case. Accordingly, in <br />consideration of the mutual benefits accruing to Entex and <br />to the City and subject to the terms and conditions hereof, <br />it is agreed as follows: <br />(lj Entex and the City agree to continue attempts to <br />settle their dispute and, in the event a settlement <br />has not been reached prior to a final determination <br />in the Beaumont case, to reopen negotiations no <br />later than ten (10) days after such final decision; <br />• <br />ENTEX, INC., P.O.
