0 -2- 0 <br />(3) Sanitary sewer easement across the Sylvan Beach <br />First Subdivision tract, granted to City of <br />La Porte, by instrument filed for record under <br />Harris County Clerk's File No. D 510146. <br />• (4) Sanitary sewer easement acorss Lot 23, W. B. <br />Lowrance Subdivision, granted to City of La Porte, <br />by instrument filed for record under Harris County <br />Clerk's File No. D 510147. <br />(5) Fence encroachment along the West line of Tract 2 <br />and a fence encroachment along the East line of <br />Tract 3, as shown by Survey by H. Carlos Smith, <br />Engineer -Surveyor, dated August 30, 1968. <br />(6) The rights of the public, if any, in that part of <br />Tract 1, traversed by North Cedar Avenue, as shown <br />on the map of Sylvan Beach First Subdivision, <br />recorded in Volume 3, Page 72, Map Records, Harris <br />County, Texas. <br />(7) The rights of the public in and to Little Cedar Bayou <br />and the rights of Harris County and the State of <br />Texas to same. <br />(8) Any titles, or rights asserted by anyone including, <br />but not limited to, persons, corporations, govern- <br />ments or other entities to tidelands, or lands <br />comprising the shores or beds of navigable or <br />perennial rivers and streams, lakes, bays, gulfs, <br />• <br />or oceans, or to any land extending from the line <br />of mean low tide to the line of vegetation, or to <br />lands beyond the line of the harbor or bulkhead <br />lines as established or changed by any government, <br />or to filled -in lands, or artificial islands; or to <br />riparian rights, or the rights of the State of Texas, <br />or the public generally in the area extending from <br />the line of mean low tide to the line of vegetation <br />or their right of access thereto, or right of ease- <br />ment along and across the same. <br />II. <br />GRANTEE shall have the right, during the time set out in <br />this Option Agreement, to purchase the hereinabove described <br />property for the total sum of Twenty-two Thousand Five Hundred <br />and No/100 Dollars ($22,500.00), to be paid at the time of <br />closing, of which the Option Money paid hereunder shall be a <br />part. <br />. III. <br />The right, privilege and option to so purchase, according <br />to the terms and provisions of this Agreement, shall terminate <br />at 12:00 o'clock Noon, October 31, 1977.
