NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF 'l'HE BAYSHORE MUNICIPAL uTILrry DIS'l'RICT THAT: Said Board of Supervisors hereby designates the City of La Porte, Texas as its agent to apply for and obtain a Federal C0""''''~:''uction Grant under EPA La\17 Number 92-500 as a part of . ,;1': as an amendment to the pending application for such a grant by the City of La Porte, and authorizes the City of La Porte to proceed with said application through step one as described hereinabove wherein an infiltration inflmv analysis and a sanitary sewer evaluation surve~, if needed, and a facility plan will be conducted and prepared, all of which will be necessary whether Bayshore Municipal utility District proceeds with this project as a joint application with the City of La Porte or whether it must proceed with its own application. Therefore, there is hereby appropriated a sufficient amount of money to repay the City of La Porte for any expenditures it must advance as the agent for Bayshore Municipal Utility District for step one, for any costs actually incurred by . reason of the inclusion of Bayshore Municipal utility District in t~e application for a construction grant. This resolution shall be effective upon the passage by the City of La Porte of a resolution or ordinance of similar content reflecting said City's acceptance of the role of agent in said application. Provided, however, nothing herein shall require' Bayshore Municipal Utility District to proceed beyond step one of said application unless and until a waiver of the -2- ""
