J ,~ <br />• <br />• <br /> <br />J <br />• • <br />EXHIF~IT A <br />(1) Permitted Uses. Company agrees to use the above- <br />described land only for the following purposes: <br />(a) Use as a site for buildings designed and <br />occupied for general office purposes, which may in- <br />clude ancillary uses as a service to occupants and <br />visitors of the office buildings, such as financial <br />institutions, cafeterias, and retail outlets. <br />(b) Use as a site for buildings designed and <br />occupied for light industrial purposes, including, <br />but not limited to manufacturing, warehousing, <br />distribution operations and research facilities. <br />Without limiting the generality of the foregoing, <br />use as an industrial gas complex as described below <br />shall be specifically permitted: <br />Tonnage gas plants (air separation plant) <br />which produce high purity gaseous oxygen and <br />nitrogen, and liquid argon, which will include <br />electrical substations, office buildings, control <br />buildings, cooling towers and other facilities <br />appurtenant to air separation plants. The only <br />air emissions from such plants will be gases <br />originally coming from the atmosphere and boiler <br />and heater emissions witri_n legal limits. The <br />only water discharges from such plants will be <br />cooling tower blow down and sanitary waste water <br />which will be treated on site prior to discharge <br />into drainage ditches. Oily rain water off <br />machinery will be collected and treated prior <br />to discharge, and any refuse, spent oil or sludge <br />from treatment systems will be hauled away fora <br />off-site disposal. <br />(c) Surface parking of vehicles or parking garage <br />for vehicles in conjunction with any of the permitted <br />uses specified in this Paragraph (1). <br />(d) Other uses that are neither specifically <br />authorized by this Paragraph (1) nor specifically <br />prohibited by Paragraph (2) will be permitted as to <br />portions of the above-described land if a description <br />of the proposed use is submitted to and approved <br />by City in writing in advance, which approval shall <br />not be unreasonably withheld. <br />(2) Prohibited Uses. The following operations and uses <br />shall not be permitted on any portion of the above-described <br />land: <br />(a) Any industrial use that is offensive by <br />reason of odor,. gas, fumes, dust, smoke or noise or <br />that otherwise constitutes a nuisance or is dangerous <br />or unsafe. <br />(b) Comme-cial exc- :ratior: of b~siiding ar .:c;n- <br />struction materials (but riot includi;.zg excavation <br />in connection with construction of improvements on <br />the Properties). <br />(c) Dumping, disposal, incineration or re- <br />duction of garbage, sewage, dead animals, industrial <br />waste or refuse. <br />(d) Drilling for anc;/or removal of oil, gas, <br />or other minerals; smelting of iron, tin, zinc, or <br />other ores; or refining o'~ petroleum or its products. <br />,7~ <br />C~~ <br />
