CITY OF LA PORTE INTER-OFFICE MEMORANDUMS Toy Mayor and Council DATE: December 02, 1981 FROM: John Joerns, Engineering D SUBJECT: Application for an Industria ste Discharge Permit - Atlanta Truck Wash, Inc. Resource Engineering, Inc., consultants for Atlanta Truck Wash, Inc., has applied to the City of La Porte for an Industrial Waste Discharge Permit under Ordinance #1221. The permit would be for an existing facility which is to be expanded and improved to include pre-treatment of wastes. The consultants have provided the City with a Feasibility Study and formal request fora discharge permit. The study has been reviewed by Jerry Hodge, David A. Paulissen, Busch-Hutchison & Associates and John Joerns. The proposed discharge shall not include any of the waste prohibited by the ordinance other than excessive B.O.D. and suspended solids. Section 17 of the ordinance allows acceptance of higher than normal B.O.D. and suspended solids, provided that: a) The wastes will not cause damage to the collection system. b) The wastes will not impair the treatment process. ,~ c) The discharger of the wastes enters into a contractual agreement with the City of La Porte providing for a sur- charge over and above the existing sewer rates. The basis for surcharge on industrial wastes is to be com- puted on the following basis: ISS = V [0.085 (BOD-250) + 0.056 (SS-300)] ISS - Industrial waste surcharge in dollars V -Volume discharged in thousand gallons BOD - Five days at 20° C BOD of the industrial waste (mg/1) SS -Suspended solids of the industrial waste (mg/1) The developers now wish to pursue the discharge permit or application. The ordinance states that "Approving Authority" for the City is the City Administrator or his duly authorized representative. Mr. Hudgens had been aware of the Feasibility Study and of the staff's review. In his absence there is no "Approving Authority"; therefore, we are requesting that Council act as the authority and direct the staff to proceed with the issuance of . this permit. During the review of the ordinance it was found that the surcharge formula for La Porte was extremely high in comparison with similar formula for other cities. The consultant plans to speak with the Council on this matter at the January 13th workshop meeting.
