C . <br />TELEPHONE <br />713 471-1886 <br />Several members of Council have inquired of our office as to the <br />validity of the appointments to the Planning and Zoning Commission <br />under the present ordinance, which provides for appointment by the <br />Mayor with confirmation by City Council. <br />It is my opinion that the appointments of the present members of the <br />Planning and Zoning Commission, as nominated by the Mayor and con- <br />• firmed by the City Council, are all valid appointments. The error <br />in the previous ordinance was the application of a portion of the <br />powers of the City Council, outlined in Article II, Section 2.09(d), <br />of the Charter of the City of La Porte, to the Mayor, in the appoint- <br />ment process. Nevertheless, the Mayor's nominees were confirmed by <br />the City Council, and, in my opinion, are lawfully appointed. <br />The appointees to the Planning and Zoning Commission, as all city <br />officers and appointees, serve at the pleasure of a majority of the <br />City Council. <br />Yours very truly, <br />Knox W.
