ORDINANCE NO.~ <br />AN ORDINANCE ESTABLISHING A SANITARY SEWER SYSTEM, CAPITAL RECOVERY <br />FEE IN THE AREA ANNEXED TO THE CITY OF LA PORTE BY ORDINANCE NO. 1393, <br />PASSED AND APPROVED DECEMBER 28, 1983; FINDING COMPLIANCE WITH THE <br />OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br />Section 1. The City of La Porte finally annexed, by Ordinance <br />No. 1393, passed and approved December 29, 1983, an approximately <br />840 acre tract of land, which included the Spenwick Place Municipal <br />Utility District and the College View Municipal Utility District. <br />The area annexed, with the exception of existing connections in <br />• Spenwick Place Municipal Utility District, is not connected to the <br />City of La Porte's Central Sanitary Sewer Treatment facility. <br />Connection to such facility has been recommended by the city's <br />engineers, and will require construction of a trunk line, pumps <br />and lift stations, and enlargement of the treatment capacity of <br />the City's Central Sanitary Sewer Treatment facility. The purpose <br />of this ordinance is to establish a Sanitary Sewer Capital Cost <br />Recovery Fee, to partially recover the City's projected costs for <br />such improvements. <br />section 2. From and after the effective date of this ordinance, <br />their shall be levied and assessed upon each building site, within <br />the territory annexed by City of La Porte Ordinance No. 1393, at <br />• the time of issuance of a City of La Porte Building permit, a <br />Sanitary Sewer Capital Cost Recovery fee, as follows: <br />A. On each single family residence, a fee of $1,000. <br />B. On each unit of a duplex, four-plex, or mult.- family <br />residence, a fee of $750. <br />C. On all other new construction, a fee based on a pro-rata <br />equivalence of the above fees, as determined by the City. <br />Section 3. All Sanitary Sewer Capital Cost 1~.ecovery Fees <br />shall be deposited in the City of La Porte Water & Sewer Improvement <br />• Fund. <br />*The recommended fee on mobile home parks shall be $750.00 per <br />unit. <br />
